Mr. Free:

Thank you for your interest in the Department of Homeland Security (DHS) Office of Inspector General (OIG). Attached please find DHS-OIG's acknowledgement of the above-referenced FOIA request.

From: Department of Homeland Security Office of Inspector General

Mr. Free:

This is regarding your above FOIA request asking for all mail to the oigauditsfollowup email address from March 1, 2019 through the date search began which was July 18, 2019. This search resulted in 7, 245 pages of material pertaining to various audits and meeting notifications and acceptance or non-acceptance. If you are searching for specific information you may wish to narrow the scope of your request, by doing this we will be able to reduce the amount of pages for review and processing and provide releasable pages quicker than if processing the entire 7,245 pages. Please let us know if you are willing or able to narrow your request.

Sincerely,

FOIA/DHS-OIG

From: Andrew Free

Thank you very much for this information. I am willing to consider narrowing this request in order to receive records more quickly. To do so, however, I need additional information regarding the contents of the 7,245 pages. I believe the most efficient way to obtain this information would be a phone call between the person responsible for reviewing the contents of the records and me. Is that possible? In the meantime, here are my initial questions:

1. To what extent OIG is able to identify what, if any, portion of these records constitutes Outlook meeting/call invites/reminders/acceptances vs. substantive content?

2. Is the organization of responsive records such search terms could be run to identify records in the inbox relating to specific facilities, inspections, or reports?

3. How long does OIG estimate the production of these records would take, and when could such production begin?

4. Does OIG anticipate any referrals to other agency components, and if so, which ones?

5. If the records were limited to only reports regarding ICE and CBP, how many responsive pages are left?

Thank you for your prompt responses to these questions.

Best regards,

Andrew

CBP-2020-006611
Dear Andrew Free:
This notice acknowledges receipt of your Freedom of Information Act (FOIA) request to U.S. Customs and Border Protection (CBP) received on 10/24/2019.     Please use the following unique FOIA tracking number CBP-2020-006611 to track the status of your request.  If you have not already done so, you must create a FOIAonline account at https://foiaonline.gov.  This is the only method available to check the status of your pending FOIA request. (https://foiaonline.regulations.gov/)
Provisions of the Act allow us to recover part of the cost of complying with your request.  We shall charge you for records in accordance with the DHS FOIA regulations outlined on the DHS website, https://www.federalregister.gov/documents/2016/11/22/2016-28095/freedom-of-information-act-regulations. By submitting your request, you have agreed to pay up to $25.00 in applicable processing fees, if any fees associated with your request exceed this amount, CBP shall contact you; however, the first 100 pages are free. (https://www.federalregister.gov/documents/2016/11/22/2016-28095/freedom-of-information-act-regulations)
Due to the increasing number of FOIA requests received by this office, we may encounter some delay in processing your request.  Consistent with 6 C.F.R. Part 5 § 5.5(a) of the DHS FOIA regulations, CBP processes FOIA requests according to their order of receipt.  Although CBP’s goal is to respond within 20 business days of receipt of your request, FOIA does permit a 10-day extension of this time period in certain circumstances pursuant to 6 C.F.R. Part 5 § 5.5(c).
CBP’s FOIA Division is working hard to reduce the amount of time necessary to respond to FOIA requests.  We truly appreciate your continued patience.
For additional information please consult CBP FOIA website please click on FOIA Act Resources or visit (http://www.cbp.gov/site-policy-notices/foia) http://www.cbp.gov/site-policy-notices/foia. (http://www.cbp.gov/site-policy-notices/foia)
Sincerely,
U.S. Customs and Border Protection

From: Andrew Free

I appeal CBP’s decision to charge fees for recovering these records. Because the agencies have not complied with the timing provisions of the FOIA it is unlawful to charge me any amount, be it $25 or $1000, to fulfill this request. Your attempt to apply these fees in violation of the law is arbitrary and capricious and I will seek referral to the Special Counsel if records are refused on that basis.
