From: Matthew Gault

To Whom It May Concern:

Pursuant to the Freedom of Information Act, I hereby request the following records:

I am requesting the Official Military Personnel File and Official Personnel File of former military service member Marco Antonio Nava Jr.

Branch: Army

Rank: Unknown.

Nava Jr. was stationed at Fort Bliss and assigned to the 377th Transportation Company, 1st Armored Division around 2016.

He plead guilty to human trafficking in 2017.

I know that service members’ records are, to an extent, protected by privacy laws but I am seeking an exception on the grounds that the service member was convicted of human trafficking.

I believe it’s in the public interest to disclose the available facts about Nava Jr’s service record.

Information I am seeking from the OMF and OMPF includes, but is not limited to full name, past and present positions, past and present titles, past and present grades, past and present job locations, dates of service, final duty status, final rank, assignments and geographical locations, source of commission, military education level, promotion sequence number, awards and decorations, transcripts of courts-martial trails, place of entrance and separation.

I am a member of the media working for VICE, with a proven track record of using FOIA information in the course of my reporting.

As such I am requesting a media waiver.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Matthew Gault
