Dear Mr. Semich:

This is in response to your Freedom of Information Act (FOIA) request to the National Archives and Records Administration (NARA), dated December 6, 2021, which we received in our office on the same date via FOIAonline. We assigned your request the above internal tracking number in addition to your FOIAonline tracking number NARA-NGC-2022-000378. In your request, you asked for:

- All reports regarding investigation into abuse of authority against Mark Lenzi. This investigation and its public report are described in a memo to Mark Lenzi from the Disclosure Unit of the Office of Special Counsel dated April 23, 2020. NARA is the repository for documents and materials created during business conducted by agencies of the Executive branch of the United States Federal government. We estimate that less than 5% of these records are designated as permanent records for legal or historical purposes. Federal agencies usually transfer their permanent records to NARA no earlier than 15 years from the date of creation, but we receive many well after 30 years from the date of creation.

The OSC letter, dated April 23, 2020, that you attached indicates that the investigation was to be done by the U.S. State Department. Any such records would be too recent to be in our custody as explained above. You may wish to make a FOIA request to the U.S. State Department. Please see https://foia.state.gov/ for further information. On that page there is a link to their Information Access Guide. The State Department does not use FOIAonline and it has more than one FOIA office. The Access Guide explains where to submit your request based on the type of records you seek.

Please note that federal agency archival records in our custody are not normally retrievable just by a person’s name. In order to do a search, we need to know the name of the agency or component within an agency that you believe created the record, the type of record, the subject of the record and a date range for the records.

This completes the processing of your FOIA request to us.

If you are not satisfied with our action on this request, you have the right to file an administrative appeal within ninety (90) calendar days from the date of this letter via regular U.S. mail or email. By filing an appeal, you preserve your rights under FOIA and give the agency a chance to review and reconsider your request and the agency’s decision.
