To Whom It May Concern:

This is a request under the Freedom of Information Act. I hereby request the following records:

Any and all records on John Parsons Wheeler, III (December 14, 1944 – December 30, 2010), known as Jack Wheeler, was a chairman of the Vietnam Veterans Memorial Fund, senior planner for Amtrak (1971–1972), official of the Securities and Exchange Commission (1978–1986), chief executive and CEO of Mothers Against Drunk Driving, consultant to the Mitre Corporation (2009–death), and a presidential aide to the Ronald Reagan, George H.W. Bush, and George W. Bush administrations. He also held numerous other positions in the United States military, government, and corporations.

On December 30, Wheeler was sighted wandering about various office buildings, including Mitre and DuPont locations, where he refused offers of assistance from several individuals. On January 28, 2011, the Delaware state medical examiner's office reported Wheeler's cause of death as assault and "blunt force trauma" without elaboration.

FOIA case law establishes the extent to which agencies MUST search all records system reasonably believed to contain responsive documents, even if it means contacting former employees. Truitt v. Department of State, 897 F.2d 540, 542 (D.C. Cir. 1990) makes it explicitly clear that it is the obligation of the Department to “conduct a search reasonably calculated to uncover all relevant documents.” In addition, the Justice Department’s May 2004 FOIA Guide states that an agency “cannot limit its search to only one record system if there are others that are likely to turn up the information requested.”

Please search all of the following DOJ components:

Office of the Attorney General
Office of the Deputy Attorney General
Office of the Associate Attorney General
Bureau of Alcohol, Tobacco, Firearms, and Explosives
Criminal Division
Drug Enforcement Administration
Executive Office for United States Attorneys
Federal Bureau of Investigation*
INTERPOL-United States National Central Bureau
National Security Division
Office of the Inspector General

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Joseph Lloyd
