Dear Bailey Pillon: This e-mail responds to your Freedom of Information Act/Privacy Act (FOIA/PA) request dated December 17, 2023, received by the Drug Enforcement Administration (DEA), FOIA/PA Unit, seeking access to DEA records.  Your request has been opened and assigned the following case number: 24-00243-F.  Please include this case number when communicating with this office. The records you seek require searches in another office or offices, and so your request falls within "unusual circumstances."  See 5 U.S.C. § 552(a)(6)(B)(i)-(iii).  Because of these unusual circumstances, we are extending the time limit to respond to your request beyond the ten additional days provided by the statute.  We have not yet completed a search to determine whether there are records within the scope of your request.  The time needed to process your request will necessarily depend on the complexity of our records search and on the volume and complexity of any records located.  For your information, this office assigns incoming requests to one of three tracks:  simple, complex, or expedited.  Each request is then handled on a first-in, first-out basis in relation to other requests in the same track.  Simple requests usually receive a response in approximately one month, whereas complex requests take longer than a month to complete.  At this time, your request has been assigned to the complex track. This letter is my formal appeal regarding the rejection of this FOIA request. I have outlined

I've noted the (b)(7)e exemption listed in the determination letter. However, per 5 U.S.C. § 552(b)(7)e:

"Records or information compiled for law enforcement purposes, but only to the extent that the production of such law enforcement records or information: E) Would disclose techniques and procedures for law enforcement investigations or prosecutions or would disclose guidelines for law enforcement investigations or prosecutions if such disclosure could reasonably be expected to risk circumvention of the law."

To that end, please review the DOJ's 7e Exemption Guide here: https://www.justice.gov/oip/page/file/1547486/download

Per the DOJ regarding techniques and procedures in the context of law enforcement:

'The first clause of Exemption 7(E) protects "techniques and procedures for law
enforcement investigations or prosecutions." The phrase "techniques and procedures"
refers to the means by which agencies conduct investigations. Specifically, a "technique"
is "'a technical method of accomplishing a desired aim'" and a "procedure" is "'a particular
way of doing or of going about the accomplishment of something'" in the context of a law
enforcement investigation or prosecution.'

Per the DOJ's definition of techniques and procedures above, I respectfully ask that the DEA undertake a good faith effort to produce the responsive records and redact portions to which b7e applies if feasible or that it be excluded from the responsive records. To be clear, I do not wish to know law enforcement techniques or procedures, and I believe excluding that it is reasonable to believe that responsive records to pertaining to Jarad Anthony Higgins (Juice WRLD) exists that do not fall under b7e. It would seem rather strange that the responsive records solely include law enforcement techniques and procedures in the context of this request.
