Dear Arnetta,

This is a request under the Freedom of Information Act. I hereby request the following records:

A list of inmates who have been held under special administrative measures both pre-conviction and post-conviction since 1998 to today. If releasing names of these inmates is not possible I would like a breakdown for every year since 1998 by gender, ethnicity, religion and charges, and whether they were/are held pre-conviction, post-conviction or both.

Additionally, I would like to request a breakdown by numbers of SAM detainees held in all of the locations where SAMS can be imposed: ADX Florence, FCC Butner, MCC New York, MDC Brooklyn, USP Terre Haute, USP Allenwood, USP Lee, FMC Devens, and FMC Carswell. In case I have missed a location in this list, I would like that location to be added to the breakdown.

I require this information for a story I'm working on. I'm a journalist, completing my master's thesis at Columbia Journalism School.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,
Fatima Bhojani

Dear Ms. Bhojani:

This is to acknowledge receipt of your email dated June 24, 2015, pertaining to "a list of inmates who have been held under special administrative measures both pre-conviction and post-conviction since 1998 to today to include names of these inmates or a breakdown for every year since 1998 by gender, ethnicity, religion and charges, and whether they were/are held pre-conviction, post-conviction or both; a breakdown by numbers of SAM detainees held in all of the locations where SAMS can be imposed: ADX Florence, FCC Butner, MCC New York, MDC Brooklyn, USP Terre Haute, USP Allenwood, USP Lee, FMC Devens, and FMC Carswell and the location to be added to the breakdown." Our FOIA office received your Freedom of Information request on June 24, 2015.

Our policy is to process FOIA requests on a first-in, first-out basis. Consistent with this policy, every effort will be made to respond to your request as quickly as possible. The actual processing time will depend upon the complexity of the request, whether it involves sensitive or voluminous records, and whether consultations with other agencies or agency components are appropriate.

It has been determined that you are an "all other use" requester. As such, we will process your request up to the first 100 pages and the first two hours of search time at no charge. If a component estimates that the total fees for processing your request will exceed $25, we will notify you in writing of the estimate and offer you an opportunity to narrow your request in order to reduce the fees. If you agree to pay fees for a records search, be aware that you may be required to pay such fees even if the search does not locate any responsive records or, if records are located, even if they are determined to be entirely exempt from disclosure.

Sincerely,

Arnetta Mallory

Our FOIA office received your Freedom of Information request on June 24, 2015.

For your information, Congress excluded three discrete categories of law enforcement and national security records from the requirements of the FOIA, See 5 U.S.C. ยง 552(c) (2006 & Supp. IV (2010). This response is limited to those records that are subject to the requirements of the FOIA. This is a standard notification that is given to all our requesters and should not be taken as an indication that excluded records do, or do not, exist.

We regret to inform you that we cannot comply to your request. The National Security Division does not handle this type of request. Therefore, your file is hereby administratively closed in the National Security Division.

Your request for information has been received. Please read this automatic reply carefully as this may be the only response you receive from this office.

If your request involves:

Inmate Records:

Inmate register numbers, age, race, sex, projected release date and location, or date released can be found on the BOP website via the Inmate Locator at:

http://www.bop.gov/iloc2/LocateInmate.jsp

The website contains information on the current prison population and on inmates released from 1982 - present. If your request is for information available on the website, this is the only response you will receive. If you are unable to access the information via the website you may resubmit your request, however, please specify that you were unable to obtain the information from the website. In order that we may continue to provide needed information in a quick and efficient manner, please also indicate why you could not obtain the information from the site.

Additionally, the database we use in our office to search for inmate information is the same database used on our website. If your search results in "NO RECORD FOUND," there is no further search our office can conduct that will provide a different response.

If you are requesting information that is not available via the Inmate Locator, (Inmate register numbers, age, race, sex, projected release date and location, or date released) please be advised that an original release Authorization from that person that is either notarized or contains a penalty of perjury statement is required. For your convenience, you may use form DOJ-361, which can be found on the BOP website for a release authorization. This request must be submitted in writing to:

FOIA/PA Office
320 First Street, N.W.
Washington, D.C. 20534

If you believe you are entitled to the information you seek without authorization from the subject of the record, you should reply to this email, and indicate that you wish us to process your request as is, without authorization. You will need to explain why you are entitled to the information without an authorization. Absent a legally sufficient reason for releasing the records without consent, your request will be denied and appeal rights will be given. Otherwise, this is the only response you will receive to such requests until a written request is submitted.

Requests for records maintained on non-inmate persons:

Requests for information on an individual cannot be processed without a current, original release Authorization from that person that is either notarized or contains a penalty of perjury statement. For your convenience, you may use form DOJ-361, which can be found on the BOP website for a release authorization. This request must be submitted in writing to:

FOIA/PA Office
320 First Street, N.W.
Washington, D.C. 20534

If you believe you are entitled to the information you seek without authorization from the subject of the record, you should reply to this text and indicate that you wish us to process your request as is, without authorization. Otherwise, this is the only response you will receive to such requests until a written request is submitted.

Requests for information not related to an individual:

All other requests will be processed and a response forwarded as soon as possible.
