This is a request under the Freedom of Information Act. I hereby request the following records:

I am seeking the full command investigation and interview transcripts of the live fire training exercise at the Hawthorne Army Depot in Nevada on March 18, 2013, which killed 7 marines.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Dear Mr. Johnson:

This acknowledges and is my final response to your request for "the full command investigation and interview transcripts of the live fire exercise at the Hawthorne Army Depot in Nevada on March 18, 2013, which killed 7 marines." You submitted your request to the Commandant of the Marine Corps on December 3, 2014. The Marine Corps assigned your request DON-USMC-2015-001522. A copy of your request was referred to the Naval Criminal Investigative Service (NCIS) on or about December 5, 2014. NCIS assigned your request DON-NAVY-2015-001598. NCIS identified a 40 page report of investigation (ROI) originated by Explosive Ordinance Disposal (EOD) Mobile Unit ELEVEN Detachment Fallon. NCIS referred a copy of your request and the EOD ROI to Navy Region Southwest (NRSW) for direct response on April 27, 2015. I received your request and the EOD ROI from NCIS on May 5, 2015. I processed your request in accordance with the Freedom of Information Act (FOIA).

I believe your request and the EOD ROI may have been misdirected. That is, NRSW does not maintain EOD ROIs. Rather, EOD ROIs are maintained and released by Navy Expeditionary Combat Command (NECC). Accordingly, I have referred a copy of your request and the EOD ROI to NECC for direct response.

Please return any questions with regard to the processing of your request by NRSW to me at this email address or (619) 532-1418.
