You may exclude news articles, press clippings, and duplicate emails.

The organization I work for, the Energy and Policy Institute (EPI), is a clearinghouse of information and can qualify as a representative of the news media. There are several examples of public record requests provided to EPI that were published on our website to inform journalists publishing articles. Additionally, federal agencies have previously categorized FOIAs from the Energy and Policy Institute under Title 10, Code of Federal Regulations, Section 1004.9(b)(3) as a "news media" requester and have determined that we satisfy the criteria considered for a waiver of fees.
   
If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

In your letter you mentioned that we did not provide enough information in order to qualify for an exemption of the fees. Please see below and let me know if this will suffice for your records.

The general public is significantly interested in the requested information and how both the federal government and the State of Georgia is moving forward with nuclear energy. Southern Company is constructing the only new nuclear reactors in the country at Plant Vogtle Units 3 and 4. This project has been the subject of serious controversy regarding its budget and its schedule, both of which may impact safety at the plant. In fact, the Atlanta Journal Constitution as well as almost every media outlet in Georgia has written about the Vogtle expansion.

The Energy and Policy Institute plans to disseminate the requested records to the general public through its web asset: energyandpolicy.org. The Energy and Policy Institute has numerous examples on its website of public records received through public records requests that not only informs the public but are published to inform other news outlets that have larger web presence to in turn inform more members of the public.

I apologize for the delay in your response. I have completed one of the files (Inspection 1134884 – 226 pages). File 1143241 is over 800 pages and is taking longer to process. The third file is also of significant size and will take longer to process than expected. I can send you the first file now.

Is there specific information you are looking for that could reduce the processing time, or do you still want the entire file for all three inspections?
