Pursuant to the Freedom of Information Act, I hereby request the following records:

1. Records documenting FBI's search referenced in OIP's decision in Appeal No. A-2023-00488. By way of context, OIP states in the decision that while the appeal was pending, FBI "conducted a [further] search but it could locate no responsive records subject to the FOIA in its files." I am looking for records that would show what repositories and files were searched and what parameters were used for the search. I'm not sure if these would be in processing notes or documented elsewhere. Please contact me if you need more clarity on what I am requesting.

2. The communications and notes of any communications between FBI and OIP pertaining to Appeal No. A-2023-00488 or request NFP-143322.

3. OIP's policies and procedures applicable to communications between OIP and an agency that is the subject of an appeal, while the appeal is pending.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I appeal the adequacy of the search and the (b)(5) redactions. Based on the appeal determination that underlies my request, it is clear that there were communications between FBI and OIP that are not included or have been redacted. Also, no material was produced for item 3. Finally, I dispute that FBI has a greater interest in communications between FBI and OIP than OIP does, and thus, OIP should have processed those communications instead of referring to FBI for direct response.
