Pursuant to the Freedom of Information Act, I hereby request the following records:

The Army Official Military Personnel File (OMPF) for Robert Mark Horrigan including form DD-214, all NCO evaluation reports DA FORM 2166-8 / DA Form 2166-9-2 / DA Form 2166-9-1 / DA FORM 2166-9-3 , all Enlisted Evaluation Reports (EER), Record of unit assignments form, dates of promotion, administrative remarks, all training courses/military education received, full military awards and citations. Mr Robert M Horrigan was reported as deceased on June 17, 2005, publicly reported by the US Department of Defense and national news media.
Date of birth 01/13/1965. BURIED AT: SECTION 60 SITE 9131 ARLINGTON NATIONAL CEMETERY
Robert M Horrigan served in the United States Army as a enlisted servicemember between approximately 1984 to 2005. Participated in Operation Desert Storm, Operation Enduring Freedom, Operation Iraqi Freedom. claimed numerous awards, badges and decorations including Combat Infantryman Badge, Bronze Star Medal, Legion of merit, Defense Meritorious Medal, Joint Service Commendation medal, army commendation medal, Good conduct medal, Army achievement medal, Overseas service bars,Scuba Diver Badge, Military Free Fall Parachutist Badge, Special Forces Tab, NATO Medal, Presidential Unit citation and etc. Please redact any sensitive information protected in accordance with the Privacy Act of 1974. Specifically request a copy of all individual /unit award citations.

PLEASE NOTE: I represent the general public and thus do not know the military service number. Please process my request for this service member's OMPF. His distinguished military service and achievements are a matter of public concern. I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be processed by a representative of the news media/press.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

I hereby request a formal appeal of denial per FA-19-0795 concerning Robert M Horrigan as provided by U.S. Army Human Resources
Command.
The public has a right to verify service dates for any veteran of the United States Army. born January 13, 1965.
Pursuant to the Freedom of Information Act, I respectfully request a copy of all award citations in OMPF, history of assignments, ranks, dates of promotions, training courses/certificates, military education, transfers, unit assignments and form DD-214. Evaluation reports can be withheld. no medical information is requested, The military award citations do not contain any classified information and are public records. A listing of authorized awards/decorations for is not classified information or considered privacy sensitive. Any sensitive information can be redacted per Privacy Act of 1974.

The U.S. Army Human Resources Command has withheld records it believes "could be reasonably expected to or would result in a clearly unwarranted invasion of personal privacy". I believe this to be false and inaccurate as the Army has published the bio publicly.

The U.S. Army Human Resources Command has withheld records claiming exemption per "10 U.S.C. § 130c, to protect sensitive information of foreign governments and international sources and methods and 50 U.S.C. § 3024(i), to protect intelligence sources and methods". I believe this to be false and inaccurate. The Official Military Personnel File including award citations do not and should not contain any classified information nor sensitive intelligence information which would be a violation of Executive Order 13526. I believe withholding the requested records is unwarranted.
