I request copies of all complaints made to the FCC about Verizon cell phones from 03/2016 to the date this request is processed. I also request all documents regarding FCC ticket number 1058431. I also request any MOUs/MOAs between the FCC and any of the following agencies: DEA, FBI, Pierce County (Washington), King County Sheriff’s Office (Washington), Pierce County Prosecutor’s Office (Washington), and the King County Prosecutor’s Office, the Harris Corporation, and Cellebrite.

From: Mike Hennigan

Dear Ms. Mcelroy, the FOIA Office has reclassified you as an “all other requester” pursuant to section 0.466(a)(8) of the Commission’s rules for fee purposes. Therefore, as an “all other requester,” the Commission assesses charges to recover the full, reasonable direct cost of searching for and reproducing records that are responsive to your request; however, you are entitled to be furnished with the first 100 pages of reproduction and the first two hours of search time without charge under section 0.470(a)(3)(i) of the Commission’s rules. The reproduction in response to your request will be submitted to you electronically, therefore you will not be charged any duplication cost. However, based on a review of your request, the search time will exceed the first two hours you are entitled to receive at no charge.

Please advise me of the maximum amount you are willing to spend for us to process your request or you may wish to consider narrowing the scope of your request to reduce the fees.

Sincerely,

Mike Hennigan

Ms. Mcelroy, as a suggestion, you might want to narrow part of the scope of your request to all complaints filed with the FCC against Verizon Wireless from 03/01/2016 to present by residents of Washington state.

Also, if you would like for me to send you a un-redacted copy of complaint number 1058431 and any records associated with the complaint, please email or fax me (202-418-0235) a copy of your proof of your identity. Generally I would redact all personal identifying information from a complaint based on Exemption 6 of FOIA., which permits agencies not to disclose files that would clearly invade personal privacy.

Sincerely,

Hello Ms. Mcelroy have you reviewed my email below? Also, have you considered modifying the scope of your request for only Verizon complaints filed by residents of the state of Washington from March 1, 2016 to present? Please advised me how we can help narrow the scope of your request. It is possible by narrowing the scope of your request to not exceed the first two free hours of search time, there could possibly be no fees involved.

Sincerely,

Mike Hennigan
