A roster or list of all agencies participating in Joint Terrorism Task Force partnerships with the FBI, including the National Joint Terrorism Task Force as well as state-, region-, county- and municipality-based JTTF partnerships.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is an appeal of the blanket denial of FOIA 1237692-0. The attached denial letter fails to substantiate the rejection of this FOIA request save by invoking three exemptions.

Two invoked exemptions have little to no relevance to the present request for listings of JTTF partnerships: the (b)(6) and (b)(7)(C) exemptions pertain to potential privacy implications of releasing the requested records. As this request pertains solely to records regarding agencies, rather than individuals. these two exemptions have no bearing as to whether the requested records are releasable.

As has been found recently in the Occupy Houston lawsuit, the FBI also invokes the (b)(7)(E) exemption in a talismanic way without any substantiation as to how the requested records could reasonably be expected to risk circumvention of the law. The requested records pertain to basic partnership information which in many cases is already public at the individual JTTF level, thus a blanket denial such as this is exceptionally inappropriate. Even if particular information might be legitimately redacted, the withholding of all records flies in the face of transparency and the FBI's obligations to disclosure under the FOIA.

For this and any other reasons deemed relevant by the appeals authority, I appeal this rejection.

The OIP appeal remand letter was received by the FBI on 3-3-15 and the request reopened on 3-4-15. The search for records responsive to your request is ongoing. This is a further appeal of the denial of FOIA 1237692-0 by the Federal Bureau of Investigations. This is now the second time that the FBI has attempted to withhold lists of JTTF members without substantiating its invocation of exemptions.

Foremost, allow me to lodge my protest of the FBI's undue delay in processing this request. I submitted this incredibly simple FOIA request for a list of all agencies that participate in Joint Terrorism Task Force partnerships in November 2013. After the FBI first rejected my request in full in April 2014, I successfully appealed to the Office of Information Policy. Now, more than two years after I first submitted my request, the FBI has returned a virtually identical response as in April 2014. This is contrary to the spirit of the Freedom of Information Act, as well as reasonable expectations given that there are only 84 pages in question.

I'll repeat the appeal on which I prevailed in 2014: The two invoked exemptions have little to no relevance to the present request for listings of JTTF partnerships: the b(6) and b(7)(C) exemptions pertain to potential privacy implications of releasing the requested records. As this request pertains solely to records regarding agencies, rather than individuals, these two exemptions have no bearing as to whether the requested records are releasable. Again, the FBI has no justification whatsoever for invoking b(6) or b(7)(C) for this request, nor has their response even attempted to substantiate how these exemptions do apply.

The FBI also invokes the (b)(7)(E) exemption in a talismanic way without any substantiation as to how the requested records could reasonably be expected to risk circumvention of the law. The requested records pertain to basic partnership information which in many cases is already public at the individual JTTF level, thus a blanket denial such as this is exceptionally inappropriate.

For one of innumerable examples where the federal government has already identified JTTF members, I point to a press release issued by the FBI itself (see https://www.fbi.gov/boston/press-releases/2009/bs102109a.htm): "The case was investigated by the FBI’s Joint Terrorism Task Force (JTTF) members: Immigration and Customs Enforcement, Customs Border Protection, Massachusetts State Police and the Lowell Police Department, in addition to other members of the FBI’s Joint Terrorism Task Force. The JTTF includes officers and agents from a number of other federal, state and local law enforcement agencies."

Even if particular information might be legitimately redacted under b(7)(E), the government's own releases preclude withholding of all the requested records. Furthermore, the FBI cannot simply withhold all 84 pages without explaining in detail the justification for invoking the exemption

The FBI's processing of this request — from the delay to the absurd invocation of exemptions without even a fig leaf of justification — flies in the face of transparency and the FBI's obligations to disclosure under the FOIA. For this and any other reasons deemed relevant by the appeals authority, I once again appeal this rejection and insist that the FBI provide the responsive records.
