A no responsive documents response.

From: David Bixenspan

To whom it may concern,

This is an appeal under the Freedom of Information Act.

According to your "no responsive documents" response for FOIPA # 1353731-000, there are/were indeed responsive documents that theoretically should still be in the custody of the FBI, but they were destroyed on January 20, 2016. Please make another attempt to locate any digital archival copies made of these documents, as it seems strange that they would be disposed of without being archived first. Regardless of the outcome that search, please produce all internal communications, inter-agency communications, and other documentation pertaining to the document destruction in question as well as the same for this FOIA request. In addition, please produce the actual computer search results that led you on your search for the destroyed documents in the original response to the request. For any of the above that exists and is not produced, please provide a complete Vaughn Index.

Thank you for your consideration of this appeal.

Sincerely,
David Bixenspan

From: David Bixenspan

To whom it may concern,

This is an appeal under the Freedom of Information Act.

Since getting the "No Responsive Documents" letter, the results of my previous appeal, and developing a better understanding of the FOIA and appeal process, I received documents in another request (FOIPA # 1353617-000) that should have been discovered via the search for this request. I have uploaded the document which mentions McMahon here: https://www.documentcloud.org/documents/3248618-1353617-0-60-HQ-4630-32.html

In light of this discovery, I am appealing to obtain a more thorough search for responsive documents about Vincent James McMahon. Please make sure to search both cross-referenced records and “ELSUR” (Electronic Surveillance) records in addition to main file records, as well as whatever other searches can be done to locate responsive documents now that it's clear that some were missed.

Thanks,
David Bixenspan
