From: Federal Trade Commission

Ms. Marshall:

This concerns your above-referenced Freedom of Information Act (FOIA) request, dated June 12, 2019, for access to "[a]ny internal Facebook emails submitted to the FTC as part of its ongoing investigation into privacy practices."

We are taking a time extension in order to properly respond to your request. The FOIA provides that an agency may extend the response time if "unusual circumstances" exist. Unusual circumstances include (1) the need to search for and collect records "from field facilities or other establishments that are separate from the office" processing the request; (2) the need to search for, collect, and examine "a voluminous amount" of records "demanded in a single request"; and (3) the need to consult with another agency or two or more agency components. See 5 U.S.C. ยง 552(a)(6)(B)(iii). In this case, your request requires the need to search for and collect records from, as well as consult with other agency components.

If you consider this an adverse determination, you may appeal by writing to Freedom of Information Act Appeal, Office of the General Counsel, Federal Trade Commission, 600 Pennsylvania Avenue, N.W., Washington, D.C. 20580, or via email at FOIAAppeal@ftc.gov<mailto:FOIAAppeal@ftc.gov>, within 90 days of the date of this e-mail. Please enclose a copy of your original request as well as this response.

You also may seek dispute resolution services from the FTC FOIA Public Liaison Richard Gold via telephone at 202-326-3355 or via e-mail at rgold@ftc.gov<mailto:rgold@ftc.gov>; or from the Office of Government Information Services via email at ogis@nara.gov<mailto:ogis@nara.gov>, via fax at 202-741-5769, or via mail at Office of Government Information Services (OGIS), National Archives and Records Administration, 8601 Adelphi Road, College Park, MD 20740.

If you have any questions regarding your FOIA request, feel free to contact me.
