Mr. Momot,

This is a follow-up to your FOIA request, 2022-05312, which seeks the following:

1. Any document containing the string "ADS-B Out OFF Authorization", including but not limited to:
a. "SLLE ADS-B Out OFF Authorization Request Template 8-15-2019.docx"
b. The Plain Language Decoder Ring for the signed ADS-B Out Off Authorization document (5 pages)
c. any ADS-B Out Off Authorization document, whether or not signed
2. Sensitive Security Information (SSI) handling guidance from the TSA SSI Office (1 page)
3. Any document or record with respect to or containing the phrase "ADS-B Out Off" or "Transponder Off" accessible to Lisa Rounsavell (lisa.rounsavell@faa.gov<mailto:lisa.rounsavell@faa.gov>)

Since portions of your request seek "any" document/record containing the specified terms, the time to search for such records will be extensive. We have estimated that the charges for conducting a search for the requested records to be $13,152.00. This estimate is based on the following:

137 hours of search x $ 96.00 = $ 13,152.00

If you are not willing to pay the estimated fee, please confirm in writing within 20 days that your original request is being withdrawn, or contact me at dean.torgerson@faa.gov<mailto:dean.torgerson@faa.gov> for assistance in reformulating your request to avoid some of these estimated charges. If we do not hear from you within 20 days, we will consider this request withdrawn.

From: Falcon Darkstar Momot

Hello Mr. Torgerson and thank you for your analysis.

Those charges are greatly in excess of what I am willing to pay for this material, and I do not want to unduly burden the FAA. What changes do you suggest to the formulation of this request to reduce the expense?

I expect that the documents in question are limited to a very small group within the FAA, since the scope of eligibility for the ADS-B Out OFF authorization is small. However, I do not have a detailed enough knowledge of the way the FAA processes such applications to make the request more specific and limited on my own. I appreciate your assistance.

From: Federal Aviation Administration

Mr. Momot,

Since you are an "all other" requester, the first two hours of search time is free. So, in response to your question as to how you could reformulate your request to reduce fees, our only suggestion would be that we could search for records which could be located in those two hours and those records are:

--"SLLE ADS-B Out OFF Authorization Request Template 8-15-2019.docx"

--The Plain Language Decoder Ring for the signed ADS-B Out Off Authorization document (5 pages)

--Sensitive Security Information (SSI) handling guidance from the TSA SSI Office (1 page)

Please advise as to whether you wish to amend the scope of your request to only seek the aforementioned records.

Thank you,

From: Falcon Darkstar Momot

How much time and expense do you think it would take for these records?
- Any document or record with respect to or containing the phrase "ADS-B Out Off" or "Transponder Off" accessible to Lisa Rounsavell (lisa.rounsavell@faa.gov<mailto:lisa.rounsavell@faa.gov>)

Thank you.

From: Federal Aviation Administration

Mr. Momot,

If you amended the scope of your request to "Any document or record with respect to or containing the phrase "ADS-B Out Off" or "Transponder Off" accessible to Lisa Rounsavell (lisa.rounsavell@faa.gov<mailto:lisa.rounsavell@faa.gov<mailto:lisa.rounsavell@faa.gov%3cmailto:lisa.rounsavell@faa.gov>>)" the fee estimate would remain the same, $13,152. Except for "Sensitive Security Information (SSI) handling guidance from the TSA SSI Office" all of the records you seek would fall into the category of containing the phrase "ADS-B Out Off" or "Transponder Off" accessible to Lisa Rounsavell.

Please let me know at your earliest convenience as to how you want to proceed. If we do not hear from you by close of business May 23, we will close your request.

Mr. Torgerson:

Alright, let's just stick with the records we could treat in 2 hours' searching then, as you mentioned:

--"SLLE ADS-B Out OFF Authorization Request Template 8-15-2019.docx"

--The Plain Language Decoder Ring for the signed ADS-B Out Off Authorization document (5 pages)

--Sensitive Security Information (SSI) handling guidance from the TSA SSI Office (1 page)

Thanks! If on reviewing those I need more, I'll follow up with a more specific request.

--Falcon
