Pursuant to the Freedom of Information Act, I hereby request the following records:
Any and all records, including reports, memos, alerts, emails, email attachments, investigative documents, intelligence documents, descriptions of chemical compounds, air and water monitoring documents, photos, studies and any other records that relate in any way to the February 3, 2023 train derailment in East Palestine, Ohio and its aftermath. This request seeks records compiled, produced, sent and/or received by EPA officials in EPA regions 3 and 5, including the EPA's on-site coordinators, contractors, as well as all scientists working on the response to the derailment. This request also seeks relevant records compiled, produced, sent and/or received by the regional administrators in EPA regions 3 and 5, as well as all records produced or in the possession of the EPA administrator's office at agency headquarters in Washington D.C. This request seeks records produced since February 1, 2023.
I am a reporter for The Guardian, The Nation and other outlets.
Given the grave urgency of the train derailment, the prominent media coverage of this issue, and the potentially dangerous health consequences for East Palestine residents, I seek expedited processing for this request. I am a reporter who publishes widely in national outlets, and will use any and all documents to produce coverage of this issue for public consumption. To the U.S. EPA FOIA Requester Community,
Some in the EPA Requester community have encountered problems creating FOIAXpress Public Access Link (PAL) accounts in the Agency's new FOIA application FOIAXpress. With the FOIAXpress application, the PAL is the best method for EPA to release voluminous records to our Requesters, without encountering MB-limiting firewalls and such transmission impediments.
The Agency is working diligently to solve this FOIAXpress issue. In the interim, we have taken the step to "push" a system-generated invitation to create a PAL account to you. You should receive an email from address noreply_nfo@epa.gov<mailto:noreply_nfo@epa.gov> with instructions on how to take the next steps to successfully establish the PAL account.
If you chose to establish this account, this would then ensure that all future interim and final responses from your FOIA requests to EPA will be available for download via the PAL. It will also allow you to submit any new requests to U.S. EPA using your PAL account.
