Pursuant to the Freedom of Information Act, I hereby request the following records:

On behalf of the #DetentionKills Transparency Initiative of Al Otro Lado, I hereby request copies of any agency records showing the policies and procedures DOL FOIA Officers require WHD personnel to follow in responding to FOIA requests. This should include training materials, PowerPoint presentations, tasking forms or templates for electronic tasking, and quality control resources. Any step-by-step instructions for what to do upon receiving a FOIA request will similarly be responsive to this request.

Please task a search that only includes records policies and procedures that are currently in force.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Your appeal is being processed. The law requires that appeals be sequenced for action on afirst-in first-out basis, consistent with the guidance provided by thecourts. See Open America v. Watergate Special Prosecution Force, 547 F.2d605 (D.C. Cir. 1976). The number ofappeals currently waiting for review is substantial. However, the Freedom of Information Actpermits multitrack processing of requests based on the amount of processingwork or time, or both, involved. 5 U.S.C. § 552(a)(6)(D)(i). Thus, we are authorized, to schedule forfaster action those appeals which require limited staff time – i.e., those thatinvolve limited scope or complexity. This is a mandatory disclosure record that should have been released without a request in accordance with 5 USC 552(a)(2)(C). The b5 redactions are going to be the subject of a request for contempt if we are forced to litigate this.

Exemption 5 does not apply to these materials, as they are instructions to staff affecting a member of the public which should have been affirmatively disclosed and indexed pursuant to 5 USC 552a2C. This search also appears to be inadequate and we appeal on that basis as well.
