A copy of Department of Defense responses during FY2022 to Questions for the Record from appropriating and authorizing Congressional committees and subcommittees.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Hello Stephen,

Thank you for the letter. In response, I'd like you to modify my request to be more specific, as follows:

I am requesting a copy of Department of Defense responses during FY2022 to Questions for the Record from the Armed Services Committee of the House of Representatives, the Armed Services Committee of the Senate, the Subcommittee on Defense of the Committee on Appropriations of the Senate, and the Subcommittee on Defense of the Committee on Appropriations of the House of Representatives.

For the analyst's further context and understanding: each federal agency is asked Questions For the Record by its appropriating and authorizing Congressional committees and subcommittees. These are called QFRs.

The questions are on the record, and so are the agency responses.

The agency's legislative relations, congressional relations, or intergovernmental offices -- the name varies with the agency -- carefully track these questions and answers.

Any federal agency, under the Freedom of Information Act, can be asked for a copy of its Responses to Questions for the Record for a given time period, for example, during Fiscal Years 2017 to 2022. Or during Calendar Years 2020 through 2022. Because they are responses to questions for the RECORD, they are typically releasable.

Hello,

The response letter states that "A request that uses open-ended phrases such as 'any and all' 'concerning or relating to' or 'including, but not limited to' is not reasonably described, as it provides an unrestricted scope in which any but the most meticulous of searches could be ruled inadequate."

Notably, I did not use any of these open-ended phrases in my request, which was reasonably described and specific.

The documents I requested were described as follows: "I am requesting a copy of Department of Defense responses during FY2022 to Questions for the Record from the Armed Services Committee of the House of Representatives, the Armed Services Committee of the Senate, the Subcommittee on Defense of the Committee on Appropriations of the Senate, and the Subcommittee on Defense of the Committee on Appropriations of the House of Representatives."

This plainly asks for responses from the DoD in Fiscal Year 2022 to Questions for the Record (QFR) from specific subcommittees. Here is an example of what this type of document looks like from the Department of Veterans Affairs: https://www.va.gov/FOIA/QFR.asp

I do not wish to narrow the scope of my request. I wish to have my request honored in a timely manner.
