Pursuant to the Freedom of Information Act, I hereby request the following records:

All records created or received by DHS in response to the FOIA request marked 2020-HQFO-01751, including, but not limited to:

1. FOIA tasking records.
2. Metadata demonstrating FOIA processing actions by DHS FOIA and agency components.
3. Notifications to DHS agency personnel or components regarding the receipt of this FOIA request, and any steps taken to process it.
4. Communications regarding 2020-HQFO-01751 or the FOIA request assigned that tracking number.

I make this request on behalf of the Al Otro Lado #DetentionKills Transparency Initiative.

I hereby request expediting processing of this request because it pertains to records regarding alleged or documenting government misconduct and lawbreaking. As to the underlying records, independent medical professionals testified on July 15, 2020, before a House Subcommittee hearing that DHS-OIG did not complete a competent death investigation into the deaths of indigenous refugee children in Border Patrol or Customs & Border Protection custody. These experts further testified that both children’s deaths were preventable. These deaths were the subject of widespread media coverage and public figures’ statements, including a statement by the then-President of the United States that one of the children’s father was to blame for his child’s death, which was broadcast throughout Guatemala and amplified by that nation’s President. With respect to the FOIA processing records at issue here, expedited processing is proper under 6 C.F.R. 5.5(e) because the Department of Homeland Security has violated the timing provisions of the FOIA by failing to make these records promptly available. The Department has also likely violated the statutory requirement that it affirmatively release on the agency’s FOIA Reading Room any set of records that has been requested three or more times.

I certify pursuant to the penalties of perjury under 28 USC 1746 that the foregoing statements regarding expediting processing are true and correct.

Please acknowledge this request, assign it an individualized tracking number, and adjudicate this request for expedited processing within ten working days, as required by law.
