DHS Disclosure & FOIA Program,

On 11/13/2020 I filed a request for the 2019 MITRE CVE Budget. On 11/19/2020 you first replied and it began a chain that ended with a final disposition of 'No Responsive Documents'. This was despite me providing a contract number (HAHQDC17J00070), a citation, the MITRE website that says it is DHS funded, a contact at DHS that could provide more information (DHS / CISA employee Jay Gazlay), and the sub-agency it is funded by (CISA). Despite all of that information, no responsive documents were returned. I filed a second request after this, updating the request from 2019 to 2020 since the calendar year changed, which I am appealing now.

A FOIA request for this same information for the same information for a different calendar year (FOIA Case # PREP06F040), demonstrating that the information is available (response letter attached). Further, I can provide a secondary contact at DHS that has direct knowledge of the CVE program (Betsy Kulick <betsy.kulick@hq.dhs.gov>).

With all of this information, I believe that responsive documents are available and the information needed to find this is present so I am appealing this disposition. MITRE runs the CVE program with funding from DHS / CISA, this is clearly stated on their website footer (https://cve.mitre.org/), so the information simply must be available.
