  • Consumer Financial Protection Bureau FOIA Response (CFPB-2014-033-F)

From: J.K. Trotter

Hello,

I am requesting clarification about the CFPB FOIA Officer’s determination that “the information you are seeking to obtain are not agency records under the purview of the CFPB.”

That appears to indicate that the CFPB does not possess or did not find any records or information responsive my original FOIA request. But later in the determination, the FOIA Officer writes that I “have the right to appeal the determination [that] the records sought are not CFPB records,” which appears to indicate that the CFPB did in fact find information responsive to my initial request.

Did the CFPB actually find records responsive to my request? Is the FOIA Officer suggesting I should have filed my request with a different agency? The determination does not make any of this clear.

Please advise, and please confirm receipt. I will leave a voicemail with my phone number on the CFPB’s FOIA hotline as well.

Thank you,

J.K. Trotter

To Whom It May Concern:

I wanted to follow up on the following Freedom of Information request, copied below, and originally submitted on Nov. 4, 2013. Please let me know when I can expect to receive a response, or if further clarification is needed. You had assigned it reference number #CFPB-2014-033-F.

Thank you for your help.

Good afternoon Mr. Trotter,

The CFPB provided our final responses to both of the requests listed in the subject line above on November 13, 2013. Additionally, Mark Vugrinovich discussed this response with you over the telephone. During this conversation, it is my understanding, that you intended to contact OGIS regarding our response and may litigate this matter in the future. Following this discussion with Mark, you sent an email (dated 11/16/13) asking us to contact your General Counsel Heather Dietrick. I provided this information to our Legal Division, whom attempted to contact Ms. Dietrick without success.

I will send this email to our Legal Davison again in the event they wish to contact Ms. Dietrick again. Thank you for contacting the CFPB FOIA Office.

From: J.K. Trotter

When did the Legal Division attempt to contact Ms. Dietrick? Did they call her or did they email her?

From: CFPB_FOIA

I believe it was on 11/18/13. Additionally, I believe they left her a message and did not receive a return phone call.
