Please forward contract #W911W417P0018 and all modifications. I am specifically interested in the performance work statement, statement of work, and statement of objections; labor categories; and deliverables. I am also interested in knowing the contract terms and conditions in the solicitation.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Mr. Williams

This email is in response to your Freedom of Information Act (FOIA) request dated November 27, 2018, FOIA Case Number 19-0024, wherein you requested a copy of purchase order W911W4-17-P-0018.

Your request was originally submitted to the US Army Intelligence and Security Command (INCOM). INSCOM does not have purview of this purchase order and therefore referred your request to us for a direct response to you.

Attached please find a redacted conformed copy of purchase order W911W4-17-P-0018. Pricing information has been withheld pursuant to Exemption 4 of the FOIA (5 U.S.C. §552(b)(4)) protects from release “
trade secrets and commercial information or financial information obtained from a person that is privileged or confidential.” Per the decision in National Parks & Conservation Association v. Morton, 498 F .2d 765 (D.C. Cir. 1974), a commercial or financial matter is “confidential” for purposes of Exemption 4 if disclosure of the information is likely to have either one of two effects: to impair the government’s ability to obtain necessary information in the future or to cause substantial harm to the competitive position of the person from whom the information was obtained.

In an effort to minimize further delay, we request that you review the redactions and identify any withheld information that you wish to receive. If you do request the withheld information, we will proceed with the submitter notification process and the Initial Denial Authority (IDA) will then determine whether the release of the information is proper under the FOIA and provide it in a final response letter. If we do not receive any notification from you, which specifically requests the release of any redacted information by February 27, 2019, this letter will become our final response and we will close this FOIA request.

Also being withheld are the names of certain Army personnel which are exempt from disclosure under exemption (b)(3) of the FOIA. This information is exempt by statue which establishes particular criteria for withholding, specifically, 10 U.S.C §130(b), which authorizes to be withheld from disclosure to the public “personally identifying information regarding – any member of the armed forces assigned to an overseas unit, a sensitive unit, or a routinely deployable unit; and any employee of the Department of Defense or of the Coast Guard whose duty station is with any such unit”.

Under the provisions of DOD Regulation, 5400.7-R, as amended, there were no assessable fees associated with this request.
