To obtain information about employment complaints filed against CBRE Inc. with your agency, as well as any other relevant federal agencies, for the past five years.

CBRE Inc. is a major real estate and investment firm with operations throughout the United States. I am specifically interested in obtaining any records of complaints filed with your agency regarding employment practices at CBRE Inc., including but not limited to allegations of discrimination, harassment, retaliation, or other forms of mistreatment of employees.

To ensure that I receive a complete set of records, I am also submitting a request to the following federal agencies:

Equal Employment Opportunity Commission (EEOC)
Department of Labor (DOL)
Office of Federal Contract Compliance Programs (OFCCP)
National Labor Relations Board (NLRB)
I am requesting any and all records related to complaints or investigations involving CBRE Inc. for the past five years, including but not limited to:

Complaints filed by current or former CBRE Inc. employees
Investigative reports related to such complaints
Any correspondence between your agency and CBRE Inc. related to such complaints
Any enforcement actions taken against CBRE Inc. related to such complaints
I understand that there may be some exemptions to the release of certain information under FOIA, and I am willing to work with your agency to ensure that any necessary redactions or other measures are taken to protect sensitive information.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Jordan Lassiter:

This email is in response to your request, under the Freedom of Information Act (FOIA), 5 U.S.C. § 552, received on April 18, 2023, in which you seek information about "employment complaints filed against CBRE, Inc." with the NLRB for the past five years, specifically, "any and all records related to complaints or investigations, listing a number of record types." You only assumed fees up to $37.00, and asked that if there were fees, to inform you of the total charges. Your request has been assigned to me.

The FOIA, 5 U.S.C. § 552(a)(4)(A)(i), provides that each agency shall promulgate regulations specifying the schedule of fees applicable to the processing of FOIA requests. Under NLRB FOIA regulations, each request for records shall contain a specific statement assuming financial responsibility in full or to a specified maximum amount, for time which may be incurred in responding to the request. Further, a request for records will not be deemed received until a written assumption of fees is received. NLRB Rules and Regulations, Section 102.117(d)(2)(vi).

A preliminary search for agency records against CBRE revealed an excess of 1,100 records, not pages, involving unfair practice charges filed against CBRE so far that may be responsive to your request. We estimate it will take approximately 20 hours to process your request, for an estimated cost of $740.00. Please note that this is just an estimate and the actual costs or the processing of this request may be more than the estimated amount. Please be advised that in order for us to process your request, you will need to inform us in writing that you are willing to assume full financial responsibility, or to a specified maximum amount, for any fees associated with your request.

Unless you assume the estimated fees associated with the processing of your request by close of business on May 3, 2023, your request will be closed.

I am in receipt of your fax and I would like to provide you with an update. I hope this finds you well, as this is the only contact information associated with your FOIA Request.

I am able to make progress on your request on a daily basis. It is a voluminous request that covers multiple cases with a large number of files. Some of the records are of poor quality or have formatting that makes the review more difficult. That being said, progress is being made on the review, but it will take some time. If there is specific information in these records that you seek, I would invite a dialog on narrowing this request, as all documents request often involve many pages that are of no interest to the requester. It is, however, difficult to have such a dialog to discuss the intricacies of the casefiles without a telephone number or email address. It also makes it difficult to provide regular updates, so I am glad that you reached out to me. You are welcome to give me a telephone call at (202) 272-3863 to check the status of your request or to have a dialog on narrowing. It is my hope that I will have my review of this request completed by mid-August and that after supervisory review, this request can close before the end of August. If I happen to find a vein of records in this record set that are duplicative of those I've already review, we may be able to beat this estimate. I can assure you that I am make regular progress on this FOIA Request.
