Dear Ms. Beasley,

Per a prior request I filed with the FBI in 2021, they claimed that they did transfer this file to the Archives. A copy of this response has been enclosed for your convenience. Based on that response it is reasonable to conclude that this record exists somewhere, either at NARA or the FBI. If the FBI does not accurately know what records they retain, transfer, or destroy, then this illustrates a problem well beyond the scope of my request. I can re-file with them but the possibility remains that they refer me back to NARA. Until this "location limbo" is solved, please continue processing my request for responsive records.

Dear Paul Galante:

I am writing in response to your Freedom of Information Act (FOIA) request
of February 28, 2024 for records in the custody of the National Archives
and Records Administration. Your request was received in this office on
March 1, 2024 and assigned FOIA tracking number RD 78612.

You requested access to FBI file number 105-HQ-139762 on a Chinese
Emergency Plan. My initial assessment is that a Chinese Emergency Plan is
the subject of the records. More specifically the majority of this file
appears to consist of warrants for individuals to be served in the event of
a national emergency involving the United States and Communist China, compiled
as part of a Foreign Counterintelligence investigation, created between
March 1965 and February 1972, and consisting of an estimated 79 pages.

These records require review for information protected from release under
the FOIA: https://www.archives.gov/foia/foia-guide#determine.

Your request does not exceed 700 pages, so it is assigned to our first-tier
processing queue. Taking into consideration our existing backlog, we
estimate it will take* 39 months to complete processing.*

Once we notify you that processing is complete, you may either visit our
College Park, MD facility to view the file at no cost, or order a
reproduction. Our current fee for reproductions is 80 cents per page, so we
estimate the total cost will be $63.20.

You must notify this office of changes to your contact information. If
communication is returned as undeliverable and no return address is
provided, your case will be administratively closed. To change your contact
information or to track the status of your request, please email
