From: Matthew Petti

Dear Sir/Madam,

I am writing to appeal the denial of my Freedom of Information Act (FOIA) request DODOIG-2023-000484. I made the request on February 1, 2023 and received a response on February 2, 2023. I appreciate the rapid response.

I understand the agency's position that my request is not sufficiently described, but I respectfully disagree. My request is for all inspector general reports completed in the year 2022 that have not been publicly posted to the agency website. To clarify, I am referring to reports compiled by the Department of Defense's Office of the Inspector General. I believe this information is within the scope of the FOIA and of significant public interest.

The agency's rejection letter states that a request must "contain file-related information, such as the type of record sought, the title, index citation, subject area, date the record was created, and the identity of the originator of the record." I appreciate the office's guidance on what constitutes a sufficiently described request, but I would like to point out that the information I have requested is already in the office's possession, and it is the responsibility of the office to locate and produce the records.

My request contains the type of record sought and the date created; it would be trivial to look through the list of reports that the office completed in 2022 and list of reports posted online. Indeed, this is public information.

In light of the above, I respectfully request that the agency reconsider its decision and conduct a search for the requested reports. I believe that the public interest in the requested information outweighs any potential harm to any privacy or confidentiality interests that may be implicated by disclosure.

Thank you for your attention to this matter. I look forward to a favorable resolution of my appeal.

Sincerely,
Matthew Petti
