Pursuant to the Texas Public Information Act, I hereby request the following records:

Basic information on all open cases of missing and murdered persons (including juveniles) within the state; this basic information can include but is not limited to: person name, age, DOB, incident date, case closure date, county/jurisdiction in which person was reported missing.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage. All of the information will also be shown on uncovered.com/cases

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Criminal matters are generally handled by local law enforcement entities and district attorneys. The Office of the Attorney General has extremely limited criminal authority. If you are seeking basic information of all open cases involving missing and murdered victims, you will need to submit your request to every law enforcement entity in the state. As for this agency, are you only looking for cases we are investigating or are you also seeking open prosecutions? Please advise.

The Office of the Attorney General has two divisions that handle murder and missing persons cases:  the Criminal Investigations Division ("CID") and the Criminal Prosecutions Division ("CRMP").  Because CID only maintains investigation files, it is easy for that division to locate records from which I can pull basic information.  On the other hand, CRMP maintains prosecution files which contain massive amounts of discovery.
CRMP has run a report in its systems and has identified 71 open murder cases.  Sixty-one cases are maintained electronically.  Ten cases are only maintained in paper form.  CRMP personnel will need to open each case file and locate records so that I can compile basic information from those cases.  There will be a charge to provide this information. Please let me know if you want us to prepare a formal cost estimate or if you only want the basic information from the 17 cases maintained by CID.  Thank you.
