Pursuant to the Texas Public Information Act, I hereby request the following records:

A list of the credit unions you have had exams for in the past two years and the dates they had the exams(/audits). Please note, previously, this information has been released to the public. Back in May 2019 Texas Credit Union Department provided a record containing the information (with dates 2017-2019) I am requesting that was then posted on a public website (www.muckrock.com). The information I am requesting is public and has been made public in the past (2019).

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

We are resending the same clarifying email sent to you around 2:31pm today, except for including the notice concerning Texas Government Code Section 552.222(e), found in this email after the same clarifying question.

We are in receipt of your Public Information request below. The Department would like to clarify your request. You would like a list of credit unions and the dates, the Department had exams for in the past two calendar years, meaning calendar years 2021 and 2022?

Please note the following in accordance with Texas Government Code Section 552.222(e):

Pursuant to Section 552.222 of the Texas Government Code: A request for information is considered withdrawn if the requestor does not respond in writing to a governmental body’s request for clarification by the sixty-first (61) day after the governmental body sends a written request for clarification. If the requestor’s original request for information was sent by electronic mail, a governmental body may consider the request for information withdrawn if the governmental body sends its request for clarification to the electronic mail address from which the original request was sent or another electronic mail address provided by the requestor, and the governmental body does not receive a timely written response or response by electronic mail from the requestor. If the requestor’s original request for information was not sent by electronic mail, a governmental body may consider the request for information withdrawn if the governmental body sent its request for clarification by certified mail to the requestor’s physical or mailing address, and the governmental body does not receive a timely written response from the requestor.

Thank you for your clarification response. We are writing to let you know that the Credit Union Department wishes to withhold the requested information because it is the Department’s position that the dates of exams are confidential pursuant to Texas Finance Code Section 126.002. Thus, the Department will be requesting an Attorney General decision for your request asserting that the requested information is confidential information. We will provide you with a copy of our written communication to the Attorney General asking for a decision. Pursuant to Texas Government Code Section 552.306, the Attorney General has 45 days after receipt of the request to render a decision, unless extended by an additional 10 business days. Thank you.
