All email communications, text messages, calendar entries (including, but not limited to any personal journals/books containing notes/dates or other material) maintained, created or maintained for Regent Steve Hicks between Hicks and the Texas Exes (aka University of Texas Alumni Association) for the period beginning January 1, 2014 to the present.

These requests should be produced in digital format.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Beryl C. D. Lipton,

This letter is in response to your below request for information received by The University of Texas System Administration (“System”) on October 22, 2015, in which you seek communications between Regent Steve Hicks and the Texas Exes during a specified time period.

System will release information responsive to your request no later than the 10 business-day deadline. However, the responsive information contains a date of birth for an identified individual, which the Attorney General’s office has recently found to be confidential by law under section 552.101 of the Texas Government Code in conjunction with the doctrine of common-law privacy. System is required to seek an Attorney General’s opinion regarding this confidential information, unless you agree to exclude dates of birth from your request.

In the attached November 5, 2015 email, which is also included below, I provided you with a copy of The University of Texas System Administration’s (“System”) request for an opinion submitted to the Texas Attorney General’s Office (“Attorney General”), a copy of the information responsive to your request with a living individual’s date of birth redacted, and a notification letter addressed to you. Within that notification letter, I explained that on November 2, 2015, I wrote to you via email inquiring as to whether you would agree to exclude a date of birth from your request. The Attorney General has held the date of birth of a living individual is confidential under section 552.101 of the Texas Government Code in conjunction with the doctrine of common-law privacy. As you did not reply to our inquiry regarding consent to exclude the date of birth, System was required by law to seek an opinion from the Attorney General to withhold the confidential date of birth. System provided you with all responsive information on November 5, with the date of birth redacted.

The Attorney General has 45 business days from the date it received our request for an opinion to issue a ruling. Upon receipt of this opinion, System will provide you a copy of the opinion, and either inform you that no additional information need be released in accordance with the ruling, or provide any information the Attorney General has held may not be withheld. Excluding holidays, I anticipate the Attorney General will issue an opinion by the middle of January 2016.

If you consent to excluding the date of birth at issue, we will withdraw our request for an Attorney General opinion and close the file.

Thank you for your email correspondence confirming that you exclude the date of birth from your request for information. Based on your exclusion, System has withdrawn our request for an Attorney General opinion, as the date of birth was the only information at issue. Please see the attached letter withdrawing the request for an opinion, which was filed with the Attorney General’s Office today.

System previously released the responsive information to you on November 5, 2015, with the excluded date of birth redacted, via the attached email correspondence.

As all information responsive to your request has been released, System now considers this matter closed. Please let me know if you have any questions or concerns regarding this matter.
