Pursuant to the state open records law Tex. Gov't Code Ann. Secs. 552.001 to 552.353, this is a request for access to and a electronic copy of Cypress Fairbanks (Cy-Fair) ISD Grading Policy for Elementary Schools implemented during the following School years:

If Cy-Fair ISD does not maintain these public records, please let me know who does and include the proper custodian's name and address.

As provided by the open records law, I will expect your response within ten (10) days. See Tex. Gov’t Code Ann. Secs. 552.221(d) and 231(c). If you believe this information is not public, I ask that you immediately notify me and then seek a formal decision from the Texas Attorney General not later than ten (10) calendar days from your receipt of this request, as required by the open records law. See Sec. 552.301.

I also request that, fees be waived as we believe this request for disclosure is in the public interest and educational purposes under Texas Government Code § 552.267. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment .

If you choose to deny this request, please provide a written explanation for the denial including a reference to the specific statutory exemption(s) upon which you rely. Also, please provide all segregable portions of otherwise exempt material.

I would note that violation of the open records law can result in a fine of up to $1,000, imprisonment of up to six months, or both. See Tex. Gov’t Code Ann. Sec. 552.353(e). Litigation costs and reasonable attorney fees may also be assessed against you. See Sec. 552.323.

Cypress-Fairbanks ISD has received your request and will begin processing as soon as possible. We will be sending you a cost estimate or statement of charges for approval, if applicable.

Please note that Section 552.275 of the Texas Government Code authorizes a governmental body to establish a reasonable limit, not less than 15 hours for a one month period or 36 hours in a 12 month period, on the amount of time that personnel is required to spend producing public information for inspection or copies to a requestor, without recovering the costs attributable to the personnel time related to that requestor. Section 552.275 does not replace or supersede other sections, and it does not preclude a governmental body from charging labor for a request for inspection or copies for which a charge is authorized under other sections of this law.

Cypress-Fairbanks ISD has established 15 hours in a one-month period and 36 hours per 12-month period as the reasonable limit on the amount of time personnel are required to spend producing public information for inspection or copies without recovering attributable costs. This 12-month period coincides with the District’s fiscal year, which begins on July 1. Requestors who exceed the 36-hour time limit in a fiscal year (or 15 hours in one month) shall pay all costs attributable to cost of materials, personnel time, and overhead expenses necessary to comply with the request, even if the requestor intends to only inspect the documents.
