We are Economics Professors in the College of Business at Ferris State University, and are engaged in an empirical research project on police behavior and citizen complaints. This project requires us to request data from your department. If you have questions about this request or suggestions, we would be happy to discuss them with you.

Could you please provide copies of the Tallahasse Police Department Internal Affairs report for 2007-2017? If not, could you please provide the following:

1. What is the total number of citizen complaints (allegations of misconduct) made against your department’s officers annually for the last 10 years? If your department logs complaints in a database, spreadsheet, or other log, a copy of those logs is fine instead.

Please include the type of complaint (i.e., use of force, abuse language, unwarranted search) and the result of complaint (i.e., sustained, exonerated).

2. What is the total number of complaints police officers made against their peer officers in department annually for the last 10 years? If your department logs complaints in a database, spreadsheet, or other log, a copy of those logs is fine instead.

Please include the type of complaint (i.e., use of force, abuse language, unwarranted search) and the result of complaint (i.e., sustained, exonerated).

3. How many officer-involved-shootings were there per year for the last 10 years in your department? Any documentation or reports that detail the annual number of officer-involved shootings in your department for the past 10 years would be sufficient.

Please include documentation regarding how many of these officer-involved shootings involved disciplinary action. (Please list officer firearm discharge directed at a person separately from a shooting involving an animal and separately from accidental firearm discharges).

Please include the number of officer-involved shootings resulting in discipline.

4. Which of the above data are published publicly? Please provide a link to any and all publicly available reports containing the data above.

Collecting this information is very important to our research, so we would like to emphasize, if you have questions about my request or suggestions, we would be happy to discuss them with you.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

Thank you for your request. As you can imagine the 10 years of information you are requesting will require extensive staff time to compile. 19,000 is a rough estimate of the total amount of documents that we have on file for the past 10 years. The staff time to gather all of the below information will be billed at $34.42 per hour. Then there is staff time to redact the reports and that would be billed at $13.42 per hour.

If you wanted a count of the total number of citizen complaints, officer-involved-shootings etc., we could provide this information instead. We can give a total for each category, but again, the staff time it took to gather the information would be billed at $34.42 per hour.

We do not have a report that tracks the type of complaint or how many of the officer-involved shootings involved disciplinary action unless we review each report individually and again that would be over 1900 reports.

These are your options and wanted to share them with you before we proceeded. Please advise how you would like to move forward with your request. Thank you.

Good Morning. Our Internal Affairs Department have completed your request. In reference to your request, documents that can be provided are noted below. The research and compiling of the documents below took 5 hours to complete at a rate of $34.42 per hour for a total of $172.10.

As noted below, there are investigative reports that need to be reviewed before we can provide them to you. This will take additional staff time. There are 34 reports, some ranging from 2 pages to 99 pages. In addition to the $172.10 there will be an additional fee for staff time to review these reports at $13.42 per hour. IAU Response to Questions
The Internal Affairs Unit conducts a "Special Investigation [SI]" whenever any member discharges any firearm in the course of their law enforcement duties, minus the three exceptions listed below, whether the intended target is struck or not. This includes “missed shots”, discharges at an animal [minus the exception], and accidental shootings [minus the exception].

SOP Internal Affairs Unit – “IAU-4 - Investigative Procedures" PROCEDURE IX – FIREARM DISCHARGE – WHEN SPECIAL INVESTIGATION REQUIRED

1. Except as noted in subsection B below, when a member discharges a firearm in the course of their law enforcement duties, the IAU shall conduct a special investigation concerning the incident, and IAU members shall adhere to the protocols of General Order 63 (Officer Involved Action Resulting in Serious Injury or Death).
2. A special investigation is not mandated in the following firearm discharge incidents:

1. Firearms training or qualification at the training academy when the member is on the firing line.
2. An unintentional discharge while engaged in training or qualification at the training academy when:
* The discharge occurs on the firing line, and
* No one is injured from the discharge.
3. A firearm discharge to destroy a seriously injured animal when injured by means other than gunfire by a member.

General Order 63 – “Officer-Involved Action Resulting in Serious Injury or Death” PROCEDURE XIII. INTERNAL AFFAIRS UNIT RESPONSIBILITIES
IAU investigators shall respond to the incident scene and their role shall be limited to observation only in order to conduct an administrative investigation and other administrative reviews based upon the circumstances (e.g., response to resistance review, vehicle pursuit review).
IAU investigators shall not be present during, or remotely monitor, any interview of an involved officer with the VCU or THU.
IAU investigators shall have access to the written transcripts and recordings of the involved officer’s interview with VCU or THU.
Unless otherwise directed by the Chief of Police, the IAU shall conduct the administrative investigation after:
1. The completion of the VCU [Violent Crimes Unit] or THU [Traffic Homicide Unit] investigation, and
2. The conclusion of any grand jury proceedings reviewing the incident.
Unless otherwise directed by the Chief of Police, or as required by another policy, the administrative investigation shall be termed a special investigation, and IAU investigators shall adhere to established protocols, to include:
1. Review of all documents, recordings, and videos related to the incident,
2. Review of applicable policies and procedures, and
3. Completion of an investigative report.
