Pursuant to the Florida Sunshine Law, I hereby request the following records:

1. the total number of use of force incidents, separated by type of force and year used in 2021 (for example, information that specifies the number of taser incidents in 2021, baton incidents in 2021, etc.). Please include as part of this a breakdown of how many use of force incidents in each year were related to law enforcement operations and how many were related to correctional/custodial operations.

2. the total number of civilian complaints alleging any form of law enforcement misconduct that were reported and the total number sustained in 2021.

3. the total number of civilian complaints alleging law enforcement use of excessive force that were reported and the total number sustained in 2021.

4. the total number of civilian complaints alleging biased policing or racial profiling that were reported and the total number sustained in 2021.

5. the total number of civilian complaints alleging criminal conduct that were reported and the total number sustained in 2021.

6. the total number of officer involved shootings in 2021, both fatal and non-fatal.

When available, I would appreciate being sent individualized data for each item in this request in spreadsheet format. If individualized data are unavailable, please send information that includes aggregate statistics for the item instead.

Note that my requests for civilian complaints are specifically for civilian complaints alleging police misconduct, please do not include complaints filed by one officer/the department against another officer.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Good Afternoon Samuel Sinyangwe,

We received your public record request on 09/13/22, my apologies for the delay in response. Please note that all future correspondence in reference to this request or any future request regarding Response-to-Resistance, and Citizens Complaints should be directed to HR@sumterso.org<mailto:HR@sumterso.org> as we handle all tracking and investigations in relation to these records. Should your request go through our records division it could delay the process as that department handles criminal records.

Your request is under review and you will receive an estimated invoice in a timely manner. Once you receive the estimate the following is the process that must be performed in order to complete your public records request:

* Requestor must state which option is preferred for the receiving of documents.

o Option 1: Paper Copy
Each document would be pulled and each page would be counted.
An estimate based on the number of pages in the file @ .15 cents per page, the estimated time needed for review, pulling, and redaction @ $15.93 per hour, will be configured.

o Option 2: Electronic Copy
Each document would be redacted and burned to a CD.
An invoice based on the price of the number of CD's required to hold the requested information @ $10.00 a CD, the estimated time needed for redaction @ $15.93 per hour, will be configured.

o Mailing Fees

The requestor has the option to pick up the records or have them mailed. Should you wish to have the documents mailed, all mailing fees will need to be paid in advance.

* Once the funds are received in accordance with the invoice, the HR Division will redact the requested records and compile the documents according to the option selected.

* Once the request has been completed you will be contacted by the HR Division.

* Documents will be available for pickup or will be mailed (once funds are received) based upon your request. Please note we do not email personnel files or portions of personnel files in conjunction with a public records request.

If you know the specific records you are looking for you may request only the redaction and duplication of these records instead of the entire personnel file. The invoice will be based on your request.

A public record is defined as: All documents, papers, letters, maps, books, tapes, photographs, films, sound recordings, data processing software, or other material, regardless of physical form, characteristics, or means of transmission, made or received pursuant to law or ordinance of in connection with the transaction of official business by any agency.

Documents provided will be in the format that is maintained by the agency and may not be in the specific format you requested. No records will be created to satisfy requests.
