Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

Any documents, databases or communication, print or electronic, regarding the admission of an inmate to either Bridgewater State Hospital or Lemuel Shattuck Hospital Correctional Unit, including the date of admission and the day of release.

Any documents, databases or communication, print or electronic, regarding the failure to admit an inmate to either Bridgewater State Hospital or Lemuel Shattuck Hospital Correctional Unit.

Any communication between Suffolk County warden and Daniel Callis Jr. or Michael Devine.

I expect the request to be filled in an accessible format. These formats include .csv, .xlsx, .docx, .pdf and .jpg. I understand names may need to be redacted.

I recognize that you may charge reasonable costs for copies, as well as for personnel time needed to comply with this request. I request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge and processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you for responding to our request. To clarify our second point, we were talking about communication between the Suffolk County Sheriff and Daniel Callis Jr. and/or Michael Devine.

As for the part of the PIA that was denied, is it possible to request the documents anonymized? We can also send an updated PIA request.

I respond to your February 19, 2018 email, and in further response to the original request which sought:

“Any documents, databases or communication, print or electronic, regarding the admission of an inmate to either Bridgewater State Hospital or Lemuel Shattuck Hospital Correctional Unit, including the date of admission and the day of release.

Any documents, databases or communication, print or electronic, regarding the failure to admit an inmate to either Bridgewater State Hospital or Lemuel Shattuck Hospital Correctional Unit.

Any communication between Suffolk County warden and Daniel Callis Jr. or Michael Devine.”

Based on your clarification, the Department submits that it does not possess documents responsive to your request of communications between the Sheriff of Suffolk County and the individuals you have identified.

Secondly, the Department does not possess any documents regarding alleged failure to admit an inmate to the medical facilities.

The Department asserts is its CORI and medical privileges previously asserted regarding the remaining request.

Hi Maria,

I wanted to make sure our request is clear because in retrospect, our initial request may not have been. We are purely looking for if the Suffolk County jail has tried to send any inmates to Bridgewater of Lemuel Shattuck hospital but have been denied due to space issues. If this has happened, we are looking to find out how many times.

We don't want any patient names or information, just the number. I hope that makes it clearer.

I am happy to resend a formal request asking for the number and making it clear that we do not want patient identities.
