2. Email communications (and any attachments) between Katy Jamboretz (kjamboretz@stlpartnership.com) and Tracy Long <tracy.long@stl.ddb.com> or Andrew Dauska <andrew.dauska@rodgerstownsend.com> from September 1, 2017 to December 1, 2017.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

1. As I stated in my initial request, I'd like the records digitally (I'd rather not kill more trees than necessary) and will happily take them by PDF which I presume is the easiest format for you to provide them in given your willingness to print them. (I presume that also would save me $6.70 in copy fees). Can you confirm that this is doable and that you'll save me two cups of coffee?

2. Can you tell me what the two hours of attorney time was for in this request?

· Question No. 1 - The Partnership will provide the production in PDF format per your request. Additionally, production in PDF format will eliminate all copying charges for this production. The total fees and costs to be paid prior to your inspection of this production are now One Hundred Twelve and 50/100 Dollars ($112.50), consisting of:

o 0.5 hours of administrative time at $25.00 per hour; and

o 2 hours of attorney time at $50.00 per hour.

· Question No. 2 - The attorney time spent on this matter has been incurred and charged consistent with the provisions of § 610.026.1, RSMo.

Thanks for the prompt clarification --- just one last question (hopefully) regarding the attorney time at $50.00 per hour.

As you are no doubt aware, §610.026.1, RSMo. requires that requests be fulfilled using employees of the body that result in the lowest amount of charges for search, research, and duplication time. Given that we seem to have established that the Partnership clearly has administrative employees that work at $25.00 an hour, and $25.00 is less than $50.00 an hour, it's unclear to me how you can claim that the attorney time spent on this matter is being charged consistent with §610.026.1, RSMo. Were these attorney's engaged in the search and production of these records that could clearly be handled by lower paid administrative staff, or were they engaged in some other level of work that could only be handled by attorneys like reviewing the records to determine if they contained confidential or privileged communication or work product which ostensibly couldn't be handled by your administrative staff thus requiring the additional fee?

Consistent with § 610.026.1, RSMo., the total fees and costs to be paid prior to your inspection of this production are now One Hundred Twelve and 50/100 Dollars ($112.50), consisting of:

The hourly rates above are a reduced rate and are less than actual costs. Once staff for the Partnership receives a check for the above amount, made out to the St. Louis Economic Development Partnership, we will make the documents available.
