Pursuant to the Missouri Sunshine Law and the Missouri Public Records Law, I hereby request the following records:

+ All emails, letters and other communication using the words “juggalo” or “juggalos” received or sent by or sent between any member(s) of the department between November 1, 2010 and December 31, 2010;

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Per the Legal Division-

In response to your request for “All emails, letters and other communication using the words “juggalo” or “juggalos” received or sent by or sent between any member(s) of the department between November 1, 2010 and December 31, 2010” the City of St. Louis Information Technology (“IT”) Division estimates it will take a minimum of one to two hours to conduct such a search. The assigned programmer’s rate is $35.60 per hour. If you wish to proceed, pre-payment of $35.60 payable to the “City of St. Louis” should be returned to the Public Information Division at the below address. Upon receipt of pre-payment, the email search will be conducted.

You will be then advised if responsive emails are identified. If so, Legal staff will review each to confirm whether or not it is open under the Missouri Sunshine Law. This review is at a rate of $24.00 per hour, and will be assessed in addition to the initial cost of IT staff. Until the initial search is complete, it is difficult to estimate how long the legal review process can take. When an estimate is provided, and prepayment is received, the review process will be done.

If you wish to proceed, please remit initial pre-payment of $35.60 (payable to the "City of St. Louis"). Again, to be clear, additional costs will be assessed based on the above processes and any responsive and open records will be provided upon payment of the balance in full. Thank you.

Thanks for your response. So to be clear: I send you the $35.60 so you can check to see if there are responsive emails. Then, if there are, you then complete the search at $24 an hour plus an undefined cost for IT search, with no limit on what you can assess? I'm just making sure I have this right.

Per the Legal Division, the charge for IT to run the search will be $35.60. If responsive emails are identified, the additional charge to review them, to confirm they are open records, is $24/hour. A more specific estimate of review time could be provided after the search is complete.
