To Whom It May Concern:

Pursuant to the Arkansas Freedom of Information Act (“FOIA”), Ark. Code Ann. § § 25-19-101 to 25-19-109, I hereby request the following records:

A copy of the written FOIA request submitted by InTouch Weekly magazine that sought a copy of a 2006 Springdale Police Department offense report concerning a sexual offense that took place at the residence of Jim Bob Duggar.

Requested records include any correspondence, written or electronic, exchanged between any employee of the Springdale Police Department and any employee of InTouch Weekly magazine regarding the fulfillment of InTouch Weekly’s FOIA request.

The request was described by InTouch Weekly in a May 2015 news article about the offense report’s contents. (“The report has been hidden since 2006 and was just obtained by the mag through a Freedom of information Act request.”) The article can be found at this URL:

Note: This request concerns InTouch Weekly’s own FOIA request, not the offense report itself.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Sincerely,

Pierce Presley
