From: Andrew Perez

To Whom It May Concern:

Pursuant to the South Carolina Freedom of Information Act, I hereby request the following records:

Copies of all available emails, documents and email attachments exchanged between officials at the South Carolina Attorney General's Office and individuals affiliated with the Rule of Law Defense Fund and the Republican Attorneys General Association, between June 1, 2017 and January 5, 2018.

Please understand “officials” to include individuals holding the following titles: Attorney General; Chief Deputy Attorney General; Deputy Attorney General; Assistant Deputy Attorney General; Senior Assistant Attorney General; Assistant Attorney General; Chief of Staff; and Communications Director.

For email addresses affiliated with the Rule of Law Defense Fund, please use email addresses that contain the domain: “@ruleoflawdefensefund.org.” For email addresses affiliated with the Republican Attorneys General Association, please use email addresses that contain the domain: “@RepublicanAGs.com.”

Please note that we are specifically requesting copies of any files or sign-on letters referenced in these emails that were uploaded to the RLDF "briefing room" at the website: "https://rldf.box.com." Sending a file through a unique link is analogous to sending a file via an email attachment, so these files should be considered public records.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

Sincerely,

Andrew Perez

This is the one I mentioned in my previous email. I also have a third email from you through muckrock that purports to be a follow up to a previous request. It may also be a duplicate. Again, I haven’t compared it to your previous requests.

Andrew,

On this one, are you suggesting that we did not respond to this FOIA request? We have responded to each and every one of your many previous requests. I will research this one, but mockruck may not have reached us with this one, again. It would be very helpful if you would just send your continued requests directly to me. I will confirm receipt. If you do not receive a response from me, it is likely that muckruck email did not reach us for some reason. In addition, South Carolina Code § 30-4-30(C), provides that a public body make a determination regarding a request for public records within 10 business days. If you do not receive a response from me regarding one of your many requests to this office, I would appreciate it if you would follow up as it is very likely we did not receive your request. We respond timely to each and every request we receive in accordance with the FOIA.

This is the same as the second foia you just sent me. MuckRock automatically sends email follow ups if an agency doesn’t respond within the mandated timeframe in each state’s foia laws. This can be very helpful on our end, in case the request slipped through the cracks, but I can see it being annoying given it wasn’t anyone’s fault in your office that our request went to a bad email address. So, again, sorry about that

Andrew,

Thank you and thank you for your call. As discussed, I have two outstanding requests for public records. One concerns that RLDF/RAGA received today, March 27, 2018 (email dated 3/26/18 was received after business hours), and the second involves a list of email addresses. This one was received on March 21, 2018.

Thanks again,
