Pursuant to the South Carolina Public Records Law, I hereby request the following records:

An audit log of all ALPR queries to out-of-state law enforcement agencies between 1/1/2023 and 2/18/2024. This request is not seeking the plate numbers or any personally identifiable information. It is seeking the date and time for conducting a query in the specific date range cited.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

Good afternoon,

Please be advised that SLED does not possess a record responsive to your request for "an audit log of all ALPR queries to out-of-state law enforcement agencies between 1/1/2023 and 2/18/2024." Additionally, know that South Carolina law does not require SLED to generate an electronic version of a record when one does not exist to fulfill a records request. See S.C. Code Ann. ยง 30-4-30(A)(2). Lastly, even if SLED did possess such records, 28 C.F.R. Part 20 and FBI CJIS Security Policy, Version 5.9 would prohibit the release of such record since any and all Criminal Justice Information Systems (CJIS) information cannot be provided to non-law enforcement sources. Therefore, federal law and policy would prohibit SLED from releasing any such records responsive to this request.
