Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, ยง10, I hereby request the following records:

All controlled substance seizure reports from January 1, 2006 to the date that this request is processed.

The documents I am requesting are referenced here (http://www.sec.state.ma.us/arc/arcpdf/MA_Municipal_Records_Retention_Manual.pdf) under the heading "Police Department" item 16.014.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is really getting out of hand. We do not have a controlled substance seizure report. We have crime reports involving seizure of drugs. There are hundreds of such reports. This in an overly broad request. Is there anything that we can do to put a stop to these requests?

Dear Mr. LeVines: The Somerville Police Department has informed me that its best estimate is that there are more than 1,700 records related to the destruction of controlled substances, each of which is multiple pages. Estimating two pages/record, this would be more than 3,200 pages at $.50/page or $1,700.00, not including time to search, segregate and redact.

At $47.32/hour, the regular rate for the lowest paid person authorized to search, segregate and redact if necessary, i.e. to determine if individual involved was a minor and to redact accordingly, it is estimated that up to ten records may be reviewed per hour (170 sets x $47.32/hour). That results in an estimate of $8,044.00, plus the $1,700.00 for copying/printing, for a cost of $9,744.00. Finally, it will take more than a month to produce all of these records.

If you are interested in receiving these documents, please forward a check in the amount of $9,744.00, made payable to "City of Somerville" to my attention at the address below. Thank you.
