Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

All performance evaluations of Newport Construction between 2010 and the present. This includes but is not limited to the "contractor project evaluation forms."

Documentation of any complaints filed against Newport Construction, and records of any disciplinary or corrective actions taken as a result of those complaints.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

All performance evaluations of Newport Construction between 2010 and the present. This includes but is not limited to the "contractor project evaluation forms."
Documentation of any complaints filed against Newport Construction, and records of any disciplinary or corrective actions taken as a result of those complaints.

In accordance with the Massachusetts Public Records Law, this email is intended to suggest a reasonable modification to, or offer assistance in modifying the scope of the request as doing so would enable the City of Somerville to respond and produce any record more efficiently and cost effectively.

As I believe you know, Newport Construction is the contractor for Mass. DOT on the Beacon Street project. Using the words "Newport Construction" as the only key word search would result in voluminous and unresponsive documents to your request. Accordingly, if you are looking for responsive records relating to Newport Construction's work on Beacon Street, it would also be helpful to include "Beacon Street" as search terms. It would also be helpful if you could further limit the scope of your request to a shorter time period.

In addition, when you request "documentation of any complaints filed against Newport..." are you limiting your request to formal complaints or is your request intended to include complaints made by members of the general public?

Once clarification of the above is received, we expect we will be able to further respond and determine if there are any responsive records or provide you with a good faith fee estimate.
