From: Shawn Musgrave

To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, ยง10, I hereby request the following records:

-A copy of the policy for reimbursement related to compensated absences that are recorded as liabilities in finances
-A record of the total amount of compensated absences that are recorded as liabilities for FY2011, FY2012 and FY2013

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Shawn Musgrave

Hi David,

You should have our response.

From: David Shapiro

Shawn,

Did you send the check to my attention? I have not received the check yet.

From: Shawn Musgrave

Hi David,

I sent it to the Personnel Department on 2013-10-18.

Please let me know if you don't receive it in a day or two, and we'll resend.

Best,
Shawn

From: David Shapiro

Shawn,

The Personnel Department staff informed me that they did not get the check. Is there a way for you to stop payment on the original check and reissue? Please send to my attention in the Law Department.

From: David Shapiro

Shawn,

Upon further reflection, does it make sense for you to wait a week or so, to see if the check resurfaces, rather than you potentially needing to spend money cancelling the check?

From: Shawn Musgrave

Mr. Shapiro,

I've just sent another check to your attention. Please confirm when it arrives.

Thank you for your help and attention,
Shawn

From: David Shapiro

Thank you Shawn. I will send the records upon receipt of the check.

From: David Shapiro

Shawn,

I have received your original check in the amount of $48.08. You had
apparently sent the original check to the Personnel Department (not Law
Department) to my attention. I now have the check.

I am now forwarding to you the requested documents in response to your
public records request dated October 3, 2013 for compensated absences.

However, the original bill was in the amount of $58.89. The Auditing
Department requires a matching bill with payment. Therefore, please
send me another check in the amount of $10.81. Send it to me directly
so that I know that is accurately addressed.

I believe you had indicated that you sent me a second check in the
amount of $48.08. I will return it to you upon receipt, unless you
instruct me otherwise.

Mr. Shapiro,

Apologies for not seeing the second check -- I'll be sure to get that out today.

It would be great if you could return the duplicate check for $48.08.

Best,
Shawn

From: David Shapiro

Shawn,

Thank you for your response. We will send the duplicate check back to you this week.

Hello,

I've finally had a chance to review the responsive documents. While the policies for reimbursement were sent, the second half of our request remains unfulfilled:

-A record of the total amount of compensated absences that are recorded as liabilities for FY2011, FY2012 and FY2013

Please indicate whether these responsive documents were gathered in response to our request.

Best,
Shawn
