To Whom It May Concern:

Pursuant to the California Public Records Act, I hereby request the following records:

- Any "Brady list," or any list of county law enforcement agents maintained or held by the office for the purposes of identifying officers who have potential exculpatory or impeachment information in their personnel files.

Please note that the California Supreme Court ruled on Aug. 26, 2019 that the contents of so-called Brady lists, so far as they relate to provisions of Senate Bill 1421, are not confidential. "Any portion of a Brady list based on these types of records is not confidential, and section 832.7(a) does not restrict dissemination of such information." (https://www.courts.ca.gov/opinions/documents/S243855.PDF)

Under Senate Bill 1421’s amendments to California Penal Code sections 832.7 and 832.8, certain types police misconduct records are now public records under California law. These records include:
1. Records related to any incident where a law enforcement officer fired a gun at a person (regardless of whether someone was hit), or used force that resulted in serious injury or death.
2. Records related to incidents where the agency found that an officer committed sexual assault against a member of the public—which includes attempts to coerce sex or proposition sex while on duty.
3. Records related to incidents where the agency found that an officer engaged in dishonesty in the investigation, reporting, or prosecution of crime or police misconduct. This kind of dishonesty could include filing a false report, testifying untruthfully, or planting evidence.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Sincerely,

CJ Ciaramella

From: Solano County District Attorney’s Office

Please see attached letter.

Thanks.
