Good afternoon Mr. Hoover and thank you for your email. An email was sent to you on February 1, 2024, informing you of the following concerning this request:

It is not practicable for the records you have requested to be made promptly available for inspection and/or copying because:

Good morning Mr. Hoover. In response to your open records request received on December 6, 2023, requesting:

Regarding Open Records Request Number 0002112 requesting: Pursuant to the Tennessee Public Records Act, I hereby request the following records: Receipts and/or invoices and/or transaction information and/or emails related to Child Evangelism Fellowship and/or the Good New Club payment for facility use fee and/or facility rental fee from January 2022 to present day, emails related to Child Evangelism Fellowship and/or the Good New Club operating at Chimneyrock Elementary from January 2022 to present day, and documents, texts, emails with the keywords "Good News Club" and/or "GNC" and/or "Child Evangelism Fellowship" and/or "CEF" and/or "Satan" from January 2022 to present day.

After completing an investigation into your inquiry, regarding the first part of the request related to facilities use fees, Shelby County Board of Education is not in possession of any public record responsive to this request.

Regarding the second part of the request seeking emails, the request is too broad to allow MSCS to determine the specific records requested. The suggested search terms are far too broad, yielding almost 50,000 emails and 56GB of data. Under Tennessee law, a governmental entity may charge for all hours of labor (after the first hour) reasonably necessary to produce requested records, including the time spent locating, retrieving, reviewing, redacting, and reproducing records. See Tenn. Code Ann. 8-4-604(a)(1); 10-7-503(a)(7)(B); Tennessee Office of Open Records Counsel, Schedule of Reasonable Charges. The labor associated with a review of 50,000 emails would exceed 500 hours. Billed at the lowest practicable hourly wage, the labor charges associated with a review of that many files would exceed $10,000.

Please let us know on or before March 8, 2024, if you do want us to proceed with the request in light of the expected labor charges, which will need to be paid in advance. Alternatively, you may submit a new more narrowly tailored request specifically describing the records sought.
