For calendars, you may provide this by directly exporting to PDF any Outlook view that shows for each and every event at least Subject, Location, Start, End, Recurrence, Meeting Status, Organizer, Show Time As, Required/Optional Attendees, Categories, Importance, Description/Body/Message, and preserving full color, formatting and text-searching. For meeting invitations, you should convert the invitations directly and individually to PDF. This includes declined or not-yet-accepted invitations, and those both sent and received for events on those days. Printing and scanning will be appealed. Any electronic format easily generated by the Named Custodian is acceptable here. Notwithstanding Gov Code 6253.3(b)(1), you may redact the Named Custodian's personal email addresses "used by the employee to conduct public business, or necessary to identify a person in an otherwise disclosable communication."

This is in response to your request below sent during non-business hours and received by the Office of the Mayor on November 4, 2019.

Please see attached, responsive to Item 1, entries for the Mayor's Prop G calendar for October 28 and October 29, 2019. Pursuant to Admin Code 67.29-5 the "Prop G" calendar shall be made available to the requestor "three business days subsequent to the calendar entry date". Accordingly, given the time of your request and the dates requested, the days provided are the available Prop G calendar entries.

Please note that future entries for the Mayor's Prop G calendar by definition do not yet exist. Please also note that future entries for the Mayor's "non-Prop G" calendar, as previously noted, are exempt from disclosure, at least pursuant to Cal. Gov. Code 6254(f) for security reasons.

We will provide a separate response for the additional records requested in Item 1.

Please note that have not located any records responsive to Item 2.

Thank you Mr. Heckel. I agree that Prop G calendar records do not need to be created and provided until 3 business days after the event *unless such records already existed*. If the Prop G calendar records between 0 and 3 business days prior existed at the time you received the request, they are public records regardless of Prop G. Prop G cannot reduce in anyway what a public record is as defined by the CPRA. I am contesting your claim about future calendars in a separate case, so the only point of contention, at this time, is the above point.

Please provide all Prop G records that existed at the time you received this request.

I want to confirm something before I file a complaint: Does the Mayor's Office still take the position that meeting items for Elsbernd and Bruss (not Breed) that are in the future as of the date of request (and recurrence entries for Elsbernd and Bruss (not Breed) that would show future meetings as of the date of request) are exempt pursuant to Gov Code 6254(f) and Times Mirror?

For example:
A. On Nov. 27, you stated "See the attached records from Sean Elsbernd's calendar responsive to your request below. Please note that certain recurrence patterns have been redacted per the previously cited security exemptions, including CPRA 6254(f) and the Times Mirror case, re future entries. "
B. On Dec. 5, in "AB Oct to Nov_Redacted," you withheld, without justification, on pages 7, 9, 12, 15 (and others) certain recurrence patterns. To be clear, these recurrences were in fact entered in by a human being and are thus "writings" (which frankly you already conceded in "A").

I want to confirm you stand by exemptions of future meetings of Elsbernd/Bruss before we file a separate complaint. Unlike 19103, these people are not the Mayor and its highly unlikely they have round-the-clock SFPD protection detail, therefore, even if we lose 19103, we would still pursue a separate case regarding Elsbernd/Bruss.

Public Works staff has already expended a significant amount of time over the past weeks to locate and determine how to process records in the format you have requested. These documents require extensive review for redaction of personal information and potential security issues, requiring additional staff time. The volume of responsive records to your request makes it impossible for us to complete your request by today’s deadline.

To date, we have been unable to identify any way to redact personal information or withhold information that may pose a security concern from ics files. Due to the scope of your request, and the substantial staff time Public Works has expended thus far, we are invoking a “rule of reason” to use additional time to respond to your request.

We will, however, continue working with our IT staff to identify a method to produce responsive records in the format you have requested as soon as reasonably possible on an incremental or rolling basis.

DPW has not released even one ICS file here, even with improper redaction which we could then debate and refine or dispute at SOTF.

It does so in contradiction of SOTF 19047, which found the ICS file format to be easily generated and required the Mayor's Office to provide it under SFAC 67.21(L).

No argument has been provided why *no part* of even one ICS file has been provided.

You are correct that have not released "even one ICS file here, even with improper redaction," because, as I wrote, we have been unable to identify any method of redacting an .ics file. I have to rely on our IT staff, and they have told me they are unaware of a way to edit an .ics file or convert an .ics file to a format that can be edited. 

The one site I was referred to that would translate .ics files into .txt files did not retain/provide much of the information you requested. The .txt file contained little more than the message, to/from fields and date information. We can easily provide those to you, but it was my understanding that such records were not sufficient. 

As you can see from the records that we released in response to your request #20-880, there are items that must be redacted for personal privacy and other reasons. Without a way to redact .ics files, we are unable to provide them to you. There are also security concerns that prevent us from releasing unredacted .ics files. Until such time as we have access to a method of redacting .ics files, we are unable to release any to you.

1. Open the ICS file in Notepad or similar.
2. Delete whatever you want. (deletion is allowed explicitly by SFAC 67.26)

1. Open the ICS file in Notepad or similar.
2. "Print" the ICS file to a PDF file.
3. Redact the PDF as you would normally. Release the redacted PDF.

This is a NEW immediate disclosure request under the Sunshine Ordinance and under the CPRA for the following (where "Requested Dates" is defined as Feb 29, 2020 to July 14, 2020 (inclusive)).

1) IMMEDIATE DISCLOSURE: an electronic copy of all of London Breed's, Andrea Bruss's and Sean Elsbernd's ("Named Custodians") government calendars scheduling entries, appointments, and meeting invitations from the Requested Dates. For calendars, you may provide this by directly exporting to PDF any Outlook view that shows for each and every event at least Subject, Location, Start, End, Recurrence, Meeting Status, Organizer, Show Time As, Required/Optional Attendees, Categories, Importance, Description/Body/Message, and preserving full color, formatting and text-searching. For meeting invitations, you should convert the invitations directly and individually to PDF. This includes declined or not-yet-accepted invitations, and those both sent and received for events on those days. Printing and scanning will be appealed. Use of PDF images as opposed to selectable text will be appealed. For examples of proper production, see DPW's PDF provision here: https://sanfrancisco.nextrequest.com/requests/19-4150 - they provide PDFs of each item, and a screenshot of all of the attendee status. I am explicitly asking for those same parts of these records. All Attachments should also be provided and in their original electronic format. Remember, all records, including even Prop G calendar records that happen to exist prior to the 3-business day rule, that are retained, owned, prepared, or used, must be produced or exempted under a non-prohibited exemption provision of the CPRA. This request includes:

2) IMMEDIATE DISCLOSURE: Furthermore, I request that a City of San Jose v Superior Court (2017) search be performed of each Named Custodian to provide: calendar items, scheduling entries, and meeting invitations for the Requested Dates that are present on their personal calendars/email or on personal accounts/devices/property (solely to the extent the record or portion thereof relates to the public's business). Any electronic format easily generated by the Named Custodian is acceptable here. Notwithstanding Gov Code 6253.3(b)(1), you may redact the Named Custodian's personal email addresses "used by the employee to conduct public business, or necessary to identify a person in an otherwise disclosable communication."

4) IMMEDIATE DISCLOSURE: every record evidencing any search of personal property, any declarations/affidavits/statements re: City of San Jose searches, any requests to search personal property and all responses, any indication of what records may or may not exist on personal property and/or which of those are or are not exempt made for EVERY prior records request from this email address. At the time you receive the instant request, of course you will not have any San Jose records for this request, but you probably will for our prior requests. We will request all of these cumulatively to ensure we eventually get them.

It is likely that you will refuse some portion, and I will appeal all withholdings, exemptions, delays, and refusals. Preserve originals of all records during my appeals.

All records must be provided in rolling fashion. Every withholding (including redactions) must be justified with clear reference to an exemption statute or case law. Exact copies are requested.

Provide only those records without fees.

My purpose is to maintain a permanent record of the Mayor's business, including through her top surrogates, regardless of how you wish to destroy records internally. Such requests will be made continually and periodically to retain this permanent public record, both forward- and backward-looking. Alternatively, the City may publish these records voluntarily and proactively, which I hope they do.

As we previously noted, Public Works staff devoted a significant amount of time trying to determine how to release records in the format you have requested. Our IT team said they are unaware of a way to edit an .ics file or convert an .ics file to a format that can be edited. These documents require extensive review for redaction of personal information and potential security issues, requiring additional staff time. We worked with you to determine if there was a format that would allow us to redact information and followed your instructions on some test files. You told us, however, that those documents did not contain the information you requested.  Our IT team was unable to identify any way to either personal information or information that may pose a security concern from ics files. For that reason, we have withheld records responsive to your request on the basis that the information contained may reveal vulnerabilities to, or otherwise increase the potential for an attack on, an information technology system of a public agency. (Cal. Govt. Code 6254.19). In addition, we have withheld records on the basis of personal privacy (Cal. Govt. Code Secs. 6254(c), 6254(k); California Constitution, Art. I, Sec. I).

Please note that personal contact information, dial-in numbers, conference call pass codes, web and video conference links and access codes and the like have been redacted pursuant to the official information privilege. Cal. Evid. Code Sec. 1040(b)(2). Attorney/Client privileged information has been redacted as indicated in the document. See Gov Code §§ 6254(k), 6276.04; Admin Code 67.23(k); Cal. Evid. Code § 950 et seq. Further, information relating to negotiations concerning labor issues and hotel procurement has been redacted because it constitutes bargaining information, the disclosure of which would place the city at a competitive disadvantage, and because the balance of the public interest disfavors production regarding such sensitive contracting and procurement information. Anonymous: Two of your cases were scheduled to be heard last evening and due to your nonappearance, the matters were continued to the call of the chair. I would like to schedule them for the December Complaint Committee hearing if that is okay with you. The draft minutes of last night's proceedings are below.

1. File No. 20111: Complaint filed by Anonymous (ARE) against Mayor London Breed, Sean Elsbernd and Hank Heckel, and the Office of the Mayor for allegedly violating Administrative Code (Sunshine Ordinance), Sections 67.21 for failing to respond to a records request in a timely and/or complete manner; 67.26, failing to keep withholding to a minimum; 67.27 failing to provide justification for withholding; 67.34 for willful failure.

The Petitioner did not make an appearance and did not notify the SOTF Administrator of their absence.
