- they did not justify in writing the withholding (67.27)
- they did not key by footnote or clear reference the redactions to justifications (67.26)
Furthermore, we believe this is non-minimal withholding (67.26) - the names of records requestors, if provided, are not secret.

We do not have any obligation to instruct the City in its legal obligations; however, we had nevertheless warned that we would file complaints for:
● withholding more than the minimum exempt portion of any record or withholding an entire record if any portion at all is non-exempt (SF Admin Code 67.26),
● failure to justify with a footnote or "other clear reference" to an exemption statute or case law for each and every redaction or withholding (SF Admin Code 67.26, 67.27)

This is a clear-cut case of violation which Respondents appear to be admitting in their response. However they appear to argue some sort of inability to comply due to reorganization which should shield them from violations. The people do not lose their Sunshine rights due to the City's reorganizations.

Did SFSD withhold any information without a written justification? Yes, no justifications were given whatsoever. (Therefore, SFSD violated SFAC 67.27).

Did SFSD mask any part of the records without keying by footnote or clear reference to a specific justification? Yes, both requesters' names and contact info. (Therefore, SFSD violated SFAC 67.26).

Did SFSD mask any part of the record that cannot actually be lawfully withheld? Yes, the requesters' names. (Therefore, SFSD violated SFAC 67.26 again).

This case is among the simplest of all that I have brought to your Task Force. Respondents should take their loss and use it as a lesson to learn from.

Respondents have the choice of having the Sheriff as department head sign and publish a consent letter addressed to me and SOTF, acknowledging the violations of 67.26 and 67.27 in this case, accepting responsibility for them, and committing in writing that SFSD will going forward comply with SFAC 67.26 and 67.27 for all requests.

Such a compromise would allow me to withdraw the complaint and is in the public interest, guaranteeing Sunshine for all.

Respondents appear to have now complied, but in an untimely fashion, which remains a violation of the law and SOTF should of course not dismiss the complaint.

What Respondents do not seem to understand is that violations are not undone when agencies only comply with the law after requesters file complaints, and SOTF routinely finds a violation for untimely or incomplete response by the City (see for example my own SOTF 19091 Anonymous v Office of the Mayor wherein the City eventually complied but was still found in violation for untimeliness).

It is unclear whether Respondents accept their legal responsibility to provide justifications and keys and minimal redaction to all records requests, without filing complaints.

I will again ask Respondents to accept responsibility to comply with SFAC 67.26 and SFAC 67.27 in future requests in a signed response, after which I can dismiss the complaint. If they do so, it is as good for me and the public interest as a formal finding of violation of the law.

As you most likely know SOTF operations have been delayed over the last few months due to the Covid-19 emergency. The SOTF have started to conduct remote meetings via videoconference and are working to establish procedures to resume all operations including the processing of complaints.
While the Sunshine Ordinance requires that certain actions be taken within 45 days, the Covid-19 emergency has forced delays and immense new backlogs for complaint hearings. We write today to ask if you are willing to waive the 45 day rule for your complaint.
The SOTF intends to resume hearing complaints on a limited basis and complaints will be queued to be heard in the near future. We continue to work to address technical issues posed by remote meetings. We are aware of the time sensitivity of your records requests. Please be assured that the SOTF appreciates the urgency of your matters and the importance of handling them in a timely manner.
