Pursuant to the California Public Records Act, I hereby request the following records:

Please respond to this immediate disclosure request: Produce all emails between former SFPUC General Manager Harlan Kelly and former SF City Attorney Dennis Herrera from Jan 1, 2019 to April 1, 2019 as exact PDF copies.

Thank you for your request for “emails between former SFPUC General Manager Harlan Kelly and former SF City Attorney Dennis Herrera from Jan 1, 2019 to April 1, 2019". The SFPUC conducted a search for emails between Harlan Kelly Jr. and Brittany Feitelberg, Dennis Herrera’s executive assistant, and we located two responsive records. Please see attached. We now consider your request closed.

 

Please be advised that we have withheld one additional record and its attachments because this record contains information that constitutes both attorney-client privileged communications and attorney work product. (See Cal. Gov’t Code § 6254(k) (exemption for records protected from disclosure under federal or state law, including provisions of the Evidence Code relating to privilege); Cal. Evid. Code § 954 (privilege for communications between attorneys and their clients); Cal. Code Civ. Proc. § 2018.030 (attorney work product doctrine); Cal. Gov’t Code § 6276.04 (cross-referencing in the Public Records Act the attorney-client and attorney work product privileges).)
