Pursuant to the California Public Records Act, Cal. Gov't Code §6250 et seq., and the San Francisco Sunshine Ordinance, SF Admin. Code Ch. 67, I hereby request the following:

-Records of Cases filed by the San Francisco District Attorney in year 2020 in which the charge(s) included violation of HS 11351, including any of its subsections.
For the records requested above, please provide the Case Number, incident date, arresting agency, list of all the charges and counts that were filed in each case, and the disposition of each case. For each conviction, please indicate if the case was resolved by plea. These records may be produced in a spreadsheet format.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

I would prefer the request filled by e-mail attachment.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 days as required by the statute.

This letter is in response to your Public Record Act request received by our office via email on July 5, 2020, making the following request:

Under the Public Records Act and the Sunshine Ordinance, a "public record" is broadly defined to include "any writing containing information relating to the conduct of the public's business prepared, owned, used or retained by any state or local agency, regardless of the physical form or characteristics." Cal. Govt. Code §6252(e). If the department has no records responsive to the specific request, the department has no duty to create or recreate one.
