To the Department Head,

Attached is an Immediate Disclosure Request (SF Admin Code 67.25(a)).
Your response is required by Dec. 17, 2019. Rolling records responses are requested (67.25(d)).

NOTE: Please be certain you have properly redacted all of your responses. Once you send them to us, there is no going back. The email address sending this request is a publicly- viewable mailbox. All of your responses (including all responsive records) may be instantly and automatically available to the public online via the MuckRock.com FOIA service used to issue this request (though the requester is an anonymous user, not a representative of MuckRock). Nothing herein is legal, IT, or professional advice of any kind. The author disclaims all warranties, express or implied, including but not limited to all warranties of merchantability or fitness. In no event shall the author be liable for any special, direct, indirect, consequential, or any other damages whatsoever. The digital signature, if any, in this email is not an indication of a binding agreement or offer; it merely authenticates the sender. Please do not include any confidential information, as I intend that these communications with the City all be public records.

Sincerely,

Anonymous

From: Department of Public Works

I am confirming that we received your emailed Immediate Disclosure Request today for records related to Mohammed Nuru's calendar (see attached).

As you know, our department uses the NextRequest online records request system and you will receive an email from Nextrequest.com with instructions for following up on this request. In the future, please make requests for Public Works records online at: http://sfpublicworks.org/records.

Our department will identify and compile the requested information. The Sunshine Ordinance requires departments to respond to an Immediate Disclosure Request no later than the close of business the next business day. Therefore, we will contact you as soon as the responsive documents are ready for you to view and will do so on or before Dec. 17, as permitted by San Francisco Administrative Code § 67.25(a).

Please note that the Public Records Act requires an agency to make available to any person a copy of an "identifiable record or records" in its possession, unless the record is specifically exempt from disclosure. (Please see California Government Code § 6253(b).) The City's obligation under the Sunshine Ordinance, like the Public Records Act, is to produce public records in its custody. (See San Francisco Administration Code § 67.20(b).) There is no requirement that a department or officer construct a document to meet the specifications of the request.

We will produce responsive records online through the NextRequest portal. However, if hard copies are needed, we can provide hard copies of any 8.5x11 documents that are made available to you at a cost of 10 cents per copy, as allowed by the San Francisco Administrative Code § 67.28(c). This section states "a fee not to exceed 10 cents per page may be charged." Postage is an additional cost.

In lieu of hard copies, we can burn the responsive records onto a CD at a rate of $1 per CD or load the responsive records onto a flash drive at a rate of $4 per flash drive. Fees for duplication are subject to change and postage is an additional cost.

Due to the need to continue searching, reviewing and redacting records, as well as your request to produce on a rolling basis, we will produce any additional responsive records as soon as reasonably possible on an incremental or rolling basis.

This responsive information has been provided in a PDF format for its ease of transferability and accessibility, consistent with Cal. Gov. We have redacted parts of records responsive to your request that constitute private personnel records of a City employee. Cal. Govt. Code Secs. 6254(c), 6254(k); California Constitution, Art. I, Sec. 1.

Can you open up 19-5144 to be viewable without login?

Also - is there a better email address for us to send requests than david.steinberg@sfdpw.org so that requests can be handled even when you are on vacation. We maintain that we have a right to request records by email (SFAC 67.21(b)).

Dear Anonymous,

We have published your request, so it will not be visible even though it has not been completed.

If you choose not to use the NextRequest portal, the best email address is still David.Steinberg@sfdpw.org<mailto:David.Steinberg@sfdpw.org>. When I am on vacation, I always enable an out-of-office message that lists at least one other individual who can respond to requests.

Dear Anonymous,

I am confirming that we received your email request today for the following record: The 2015 memo from the City Attorney's Office regarding maintaining department head calendars.

Our department will identify and compile the requested information. The Sunshine Ordinance requires departments to respond as soon as possible or within 10 calendar days from receipt of any records requests. Therefore, we will contact you as soon as the responsive documents are ready for you to view and will do so on or before Dec. 30, as permitted by San Francisco Administrative Code § 67.21(b) and California Government Code § 6253(c).

Hi there

Record request #19-5201 has been closed and published. The closure reason supplied was:

We have conducted a diligent search for records responsive to your request. We have located responsive records, which you may view at the following link: https://www.sfcityattorney.org/wp-content/uploads/2015/07/Public-Calendar-Requirements-for-Elected-Officials-and-Departments-Heads.pdf.

If you have trouble accessing the files, we can burn the responsive records onto a CD at a rate of $1 per CD or load the responsive records onto a flash drive at a rate of $4 per flash drive. Fees for duplication are subject to change and postage is an additional cost.

Please note that the Public Records Act requires an agency to make available to any person a copy of an “identifiable record or records” in its possession, unless the record is specifically exempt from disclosure. (Please see California Government Code § 6253(b).) The City’s obligation under the Sunshine Ordinance, like the Public Records Act, is to produce public records in its custody. (See San Francisco Administration Code § 67.20(b).) There is no requirement that a department or officer construct a document to meet the specifications of the request.

Hi there

Record request #19-5144 has been closed and published. The closure reason supplied was:

We have conducted a diligent search for records responsive to your request. We have located responsive records for Item 3 of your request, which we are making available to you.

This responsive information has been provided in a PDF format for its ease of transferability and accessibility, consistent with Cal. Gov. Code 6253.9(a)(1).  Metadata from any native format has not been provided to avoid risks to the security and integrity of the original record as well as the city’s data and information technology systems and to avoid the release of exempt confidential or privileged information.  See Cal. Gov. Code 6253.9 (f) and 6254.19.  The PDF format ensures the security and integrity of the original record as well as the security and integrity of the city’s data and information technology systems.

Please note that some calendar items may not include all meeting attendees. An Aug. 7, 2015, memorandum from the City Attorney's Office advises: "For meetings with more than ten attendees, names of the attendees and the organizations they represent need not appear on the daily calendar."

If you have trouble accessing the files, we can burn the responsive records onto a CD at a rate of $1 per CD or load the responsive records onto a flash drive at a rate of $4 per flash drive. Fees for duplication are subject to change and postage is an additional cost.

If hard copies are needed, we can provide hard copies of any 8.5x11 documents that are made available to you at a cost of 10 cents per copy, as allowed by the San Francisco Administrative Code § 67.28(c). This section states "a fee not to exceed 10 cents per page may be charged." Postage is an additional cost.

Due to privacy concerns, personal information, such as personal phone numbers, cell numbers and email addresses, has been redacted from the documents that we are making available to you. We redacted this personal information pursuant to Section 6254(c) and Section 6254(k) of the California Public Records Act and Article 1, Section 1 of the California Constitution.

Please note that it is not necessary to create a NextRequest account to view responsive records. Once they have been released, a link, valid for 30 days, will be provided to view the records. Additionally, unless privacy concerns prevent it, Public Works makes all records requests visible to the public. You may search for requests at https://sanfrancisco.nextrequest.com/.

This concludes your public records request.

RE: Calendars and Emails - Immediate Disclosure Request

DPW,

Below are Immediate Disclosure Requests (SF Admin Code 67.25(a)) directed to DPW and the Interim Director. Your response is required by Jan 30, 2020. Rolling records responses are requested (SFAC 67.25(d)) if you are unable to immediately produce records. Exact copies of every responsive record are requested (Gov Code 6253(b)) - do not: provide mere URLs, or print and scan electronic records, convert to PDFs, or provide black and white versions of any color record. Provide only copies of records not requiring fees and in-person inspection of all other records (GC 6253).

Your non-exhaustive obligations: All withholding of any information must be justified (SFAC 67.27). All withholdings by masking or deletion (aka redactions) must be keyed by footnote or other clear reference to justification and only the minimal exempt portion of a record may be withheld (SFAC 67.26). Respond to emailed requests (SFAC 67.21(b)). You must notify us of whether or not responsive records exist and/or were withheld for each below request (Gov Code 6253(c), 6255(b)). You must state the name and title of each person responsible for withholding any information (Gov Code 6253(d)). You must do all of this in your response, and you cannot wait until we file complaints.

****** We have no duty to, and we will not again, remind the City of its obligations. Instead, we will file complaints for every Sunshine Ordinance or CPRA violation. We will continue to file complaints until your procedures are modified to fully comply with the Sunshine Ordinance and CPRA, without caveat or exception. ******

1. The entirety of all Prop G calendars currently in the possession of DPW, whether for the former Director or the current Interim Director as far back as your computer systems currently store them. All withholdings or redactions will be immediately appealed. Preserve all records during the pendency of appeals.

Hi there

Record request #20-445 has been closed and published. The closure reason supplied was:

We have conducted a diligent search for records responsive to your request. We have located responsive records and are releasing them to you.

Your request for "a complete employee directory" was not entirely clear, so we interpreted this to mean a list of all Public Works employees, which we were able to extract from a spreadsheet and have provided to you in PDF form. If this is not the type of record or records you were interested in, we invite you to submit a new request that more clearly sets forth the record or records you are seeking. In addition, the department is available to assist you in formulating a clearer request. Please feel free to contact us for this purpose.

As you know, the Public Records Act requires an agency to make available to any person a copy of an “identifiable record or records” in its possession, unless the record is specifically exempt from disclosure.

Hi there

A message was sent to you regarding record request #20-444:

We have conducted a diligent search for records responsive to your request. We have located responsive records, which we are making available to you now. Please note that these records cover 2015 and were produced in January 2016 in response to a previous records request; all redactions, as noted below, were made by Frank Lee, the San Francisco Public Works custodian of records at the time.

Due to the need to continue searching and reviewing, the need to redact records and your request to produce on a rolling basis, we will produce any additional responsive records as soon as reasonably possible on an incremental or rolling basis.

We have withheld records responsive to your request [and/or redacted parts of the records provided in response to your request] that constitute private personnel records of a City employee. Cal. Govt. Code Secs. 6254(c), 6254(k); California Constitution, Art. I, Sec. 1.

Thank you Mr. Steinberg, but please publish to my specific request whichever documents you consider responsive. Disk space should not be a concern. I need a specific set of responsive records for this request that I can specifically challenge, whether or not any other requestor wants to fully enforce the Sunshine Ordinance, as I do.

Please do not include any confidential information, as I intend that these communications with the City all be disclosable public records.

Hi there

A message was sent to you regarding record request #20-444:

We are responding to your letter received earlier today about documents responsive to your request.

We have received multiple overlapping requests similar to yours, and in an effort to meet all legal deadlines, we are responding in the most efficient way. We believe we have satisfied the requirements of the Sunshine Ordinance by providing to you links to the responsive documents that were released through other records requests.

For reference, please note this advice written by the City Attorney's Office for responding to public records requests:

The Public Records Act requires departments to assist members of the public to identify records and information that are responsive to the request or the purpose of the request, if stated; describe the physical location and information technology in which the requested records exist; and provide suggestions for overcoming any practical basis for denying access to the records or information sought.  The department will have satisfied these requirements even if it is unable to identify the requested information after making a reasonable effort to elicit additional clarifying information from the requester.  Cal. Govt. Code §§ 6253.1(a), (b).

RE: 20-444

Frankly I don't understand what that citation has to do with anything. If I ask for a copy of some records I get a copy.
The request you pointed me to (https://sanfrancisco.nextrequest.com/requests/20-428) has over one thousand records. Which ones are responsive to my request? I do not believe the requestor is supposed to search the records instead of the City, even under CPRA.

I will also be enforcing 67.26. You have followed those rules in the past and I'm not sure why, when things become critical, these rules would be thrown out the door.

Hi there

A message was sent to you regarding record request #20-444:

We received your public records request, dated Jan. 30 for Prop. G calendar items.

Pursuant to California Government Code Section 6253(c), we are invoking an extension of up to 14 days (until Feb. 24) because of the voluminous nature of the request, the need to consult with another department and the need to compile or extract electronic data. We will endeavor to complete our response before that date.

Hi there

A message was sent to you regarding record request #20-444:

Although Prop. G requires that department head calendars be maintained for two years, a period of time that is listed in our records retention policy, it has not been the practice to delete older copies.

For this reason, the Prop. G calendar for Mohammed Nuru extends back to his appointment as director in 2011. For this reason, there are potentially thousands of responsive records, all of which would need to be reviewed and potentially redacted to protect private information of individuals contacting the department. To facilitate a prompt reply, we suggest you limit your request to a shorter time-frame and/or a more limited scope.

To date, we have released to you calendar entries for all of 2015 and sent you a link to a request containing all calendar entries for January 2020.

Please let us know how you would like to proceed.

Regards,

I am following up on our communication of Feb. 10, in which we asked you to limit your request for records. Please let us know if a shorter time-frame would be acceptable.

Also, before we work to produce additional records, we want to ensure that the format we have used in the records already released is acceptable. We have used this format to facilitate a reasonable response time.

RE: REQUEST 20-444:

Please preserve and do not destroy all responsive records, however you may prioritize the present, and go backwards.
Any format that has ALL required elements of SFAC 67.29-5 is acceptable: times, places, statement of issues discussed if the meeting is not publicly recorded, identity of attendees who are not DPW employees when required.
Native non-PDF formats are not required.
However, compliance with SFAC 67.26 and 67.27 re: keys, justification, etc. remains mandatory, regardless of anything else.

Request 20-444:

Mr. Steinberg,

Thank you for keeping up with what appears to be mostly compliant Sunshine responses at this time.
Can you confirm that all redactions in the 36 records so far provided that are not specifically keyed to a justification are Constitutional privacy?
Can you also provide an estimate of how long it would take for DPW to produce say one month of Prop G calendars so I can extrapolate and prioritize?

What I care most about is that records don't vanish intentionally or through some auto-delete process. If everything is on litigation hold I guess it wouldn't matter anyway.

Hi there

A message was sent to you regarding record request #20-444:

I am replying to your email dated Feb. 13: As I wrote on Feb. 4, the 2015 calendar items that we released were in response to a 2016 public records request that former Custodian of Records Frank Lee fulfilled. At the time, he cited the privacy restrictions as the reason for the redactions. I will upload to you shortly a copy of his response to that request, citing the justification for the redactions.

Regards,

David A. Steinberg

Request #20-444:

Thank you Mr. Steinberg. You also asked me about format acceptability. I am fine with PDFs that show all 67.29-5 information.
Raw ICS files are not needed at this time.

Is this enough information about format or were you looking for something else?

Sincerely,

Anonymous

Hi there

A message was sent to you regarding record request #20-444:

Regarding the formatting, I specifically was asking about how much of the information you were requesting and the view.

For example, the 2015 calendar that we released to you showed a PDF version of each single day with summary information, but it did not contain a full list of attendees, affiliations and contact information that is required of some calendar entries under Prop. G.

As you can imagine, it would be much faster for us to produce the records in this daily format. In contrast, in response to your previous requests, we have created a PDF of each individual calendar item (or two if the list of attendees is required), then review for redactions, etc. Because of how information is kept on the director's calendar (such as vacations or sick days of key employees, recurring meetings that are informational only and not attended), there may be a dozen or even dozens of individual entries each day that need to be formatted.

Also, I just found out that Myisha is not in today, so I will get back to you next week with an estimate of how long it should take to produce records in response to this request.

Regards,

Hi there

A message was sent to you regarding record request #20-444:

Thanks for the clarification. PDFs of daily calendar entries will greatly increase our ability to get the records to you.

Please note also that we previously produced calendar records in response to your requests #19-4150 (9/30/19, 10/2/19) and 19-5144 (11/10-17/19), so those dates will not be duplicated in the forthcoming production.

Hi there

A message was sent to you regarding record request #20-444:

We have conducted a diligent search for records responsive to your request and have located responsive records. Because of the expansive nature of your request, the volume of records responsive to your request is significant. Public Works staff has already expended a significant amount of time over the past weeks to locate and process records. These documents also require redaction of personal information, requiring additional staff time. The volume of responsive records to your request makes it impossible for us to complete your request by today’s deadline.

Public Works staff will continue to process your request over the coming weeks. But due to the scope of your request, and the substantial staff time Public Works has expended thus far, we are invoking a “rule of reason” to use additional time to respond to your request. We will, however, continue searching, reviewing and redacting records, and will produce additional responsive records as soon as reasonably possible on an incremental or rolling basis.

Regards,
