Pursuant to the California Public Records Act, I hereby request the following records:

All records related to communications between the San Diego County District Attorney's Office (and its officials, employees or contracted staff) and the San Diego Reader (and its employees, staff, writers, etc.) for the time period Nov 1, 2020 through Jan 9, 2023. California courts have ruled that communications between the media and public employees or elected officials are public records under the CPRA and are generally not able to be excluded under the CPRA's investigative, deliberative, or privacy exceptions.

This request includes, without limitation, emails, voicemails, texts, faxes and written letters. This request also includes any meeting minutes or notes, memoranda, briefings, calendar or appointment book entries, or other writings related to meetings, interviews, calls, or briefings between anyone with the DA's office and the San Diego Reader (and its employees, staff, writers, etc.). For completeness, please include, without limitation, the terms "San Diego Reader", "SD Reader", "S.D. Reader", and "SDReader" in your searches.

As you are no doubt aware, the California Supreme Court has ruled that records involving personal accounts & devices used to conduct public business are public records under the CPRA. Therefore, I request that reasonable searches for responsive records be conducted on all personal accounts and/or devices used by the following DA's office employees: Summer Stephan, Tanya Sierra, Steve Walker, William Hopkins, Makenzie Harvey, Katherine Johnson, Jonah Conley, Justin Bostic, Mathew Grindley, Elvys Cabrera, Luis Pena, Joshua Pittsley, Elliot Shafer, Kelly Stinnette, and Felix Salazar.

To the extent that responsive records include emails, I request that email attachments be included in production.

To the extent that responsive records include emails or calendar invitations, I request without limitation all emails and/or calendar invitations where a sender OR recipient (including bcc) has a domain of "sdreader.com" or "sandiegoreader.com".

If any responsive records are in digital format, that's the format I need to see them in.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Hello,

On Jan 9th, 2023 I sent a request for public records to your agency pursuant to the California Public Records Act. It is now Jan 20th and I have yet to receive a response from your agency.

California Government Code § 7922.535(a) (2021))* expressly requires that an agency provide a response to a public records request within ten calendar days of receipt of that request. By failing to respond to my request within the legally-mandated timeframe, your agency is in violation of the law and you are exposing your agency to litigation.

Please provide acknowledgement of this request and the responsive materials forthwith. If such materials cannot be produced, please provide an appropriate explanation for this rejection, as is dictated by this agency's legal obligations under the California Public Records Act. Your accelerated attention to this matter will be greatly appreciated.

*The PRA was recodified by A.B. 743, which took effect January 1, 2023. A disposition table indicating how the PRA’s provisions have been renumbered is available at http://clrc.ca.gov/pub/Printed-Reports/Pub241-G400-Disposition.pdf. The changes are “entirely nonsubstantive.” Govt. Code § 7920.100.

If it makes production easier, you can remove all emails originating from the address "newsletters@sandiegoreader.com" from production. These are the automatic emails sent to subscribers of SD Reader's newsletter; I am not interested in these automated newsletter emails.
