Pursuant to the California Public Records Act, I hereby request the following records:

1) Copies of all voluntary and mandatory surveys, personality tests, assessments, and questionnaires offered to students through Naviance and/or PowerSchool. Please note: I am requesting blank/template copies, not records containing any student information. I will accept screenshots of each page of a survey, test, assessment, etc. if a single document is not available.

2) A data dictionary/library for all data fields within the district’s Naviance and/or PowerSchool system.

3) All user manuals, guidebooks, or instructions provided to the district by Naviance and/or PowerSchool regarding the use of its/their products.

4) All district policies and instructions for district employees regarding use of Naviance and/or PowerSchool products.

5) All contracts and data privacy agreements between the district and Naviance and/or PowerSchool. Please also include any other formal documentation from Naviance and/or PowerSchool regarding the third parties with which it/they share aggregate or personally identifiable student data. This should include colleges and universities, testing companies, and data clearinghouses/brokers.

6) Any notifications sent by Naviance, PowerSchool, or Hobsons to the district regarding Hobsons’ sale of Naviance to PowerSchool. This should include any documentation regarding the handling or transfer of the district’s student data as part of the sale.

If you have any questions about any aspect of this request or would like to discuss ways to streamline or adjust the request, please do not hesitate to contact me.

I ask that all fees be waived as I am a journalist and intend to use the requested records to publish articles in the public interest. In the event you choose to impose fees, I request a detailed breakdown of the fees, including the hourly wage of each employ involved and an explanation justifying the employee hours required to fulfill the request.

Should you choose to reject this request or redact portions of it, I ask that you provide a detailed breakdown of the statutory exemptions and associated case law underlying your decision to withhold each/any portion from public review.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

In regards to your Public Records Act Request, FY20212022.023. This letter shall constitute the District’s initial response under the California Public Records Act (“the Act”) and is not intended to be exhaustive. The District reserves the right to amend its initial position following a careful search for and review of records and identification of additional exemptions.

Generally Applicable Response to Request for Records
Pursuant to the Act, we will make non‐exempt responsive documents in our possession available as soon as they are identified and compiled. We will be exercising our discretion to withhold exempt records. Specifically, we will not be providing the following:

* Records that fall within the exemption provided for by Government Code section 6254(a) (preliminary drafts, notes, or interagency or intra‐agency memoranda that are not retained by the public agency in the ordinary course of business, if the public interest in withholding those records clearly outweighs the public interest in disclosure);

* Records exempt from disclosure pursuant to Government Code section 6254(c);

* Records exempt from disclosure pursuant to Government Code section 6254(f) (records of complaints to, or investigations conducted by the District);

* Records exempt from disclosure pursuant to Government Code section 6254(k) (exempt or prohibited from disclosure pursuant to federal or state law, including, but not limited to, provisions of Evidence Code related to privilege); and

* Protected individually identifiable health information exempt from disclosure under the “public interest” exemption in Section 6255 of the Act.

In those cases where it is possible to redact information from an otherwise exempt record, we will do so and make available to you the redacted record. Pursuant to California Government Code section 6253(c), which entitles public entities to recover the reasonable costs to produce records, the District only provides copies upon receipt of payment for costs of copies, which is $.10 per page. I will notify you if there are any costs associated with your request once I have determined how many responsive documents there are.

Finally, to the extent that any of the records you seek can be found via our District website (www.sandiegounified.org<http://www.sandiegounified.org>) we will not provide copies of those documents as they are available to the public 24 hours per day, 7 days per week. We will endeavor to provide you with links to such records whenever possible.

In response to your requests, the District responds as follows:

Final Response 1: Because we no longer have a contract with Naviance, we do not have access to the surveys that they offered.

Therefore there are no responsive documents to this portion of your request.

Final Response 2: Our software licensing agreement with the software company (PowerSchool) prevents the district from providing proprietary information about their product which includes how their database is structured/designed.

Therefore, there are no non-privileged responsive documents responsive to this portion of your request.
