Under the Act, an agency is not required to create or retain documents. The County is only obligated to provide access to those records which in fact have been created and retained. The County does not generally maintain the requested information; however, the County does maintain such information within a database. The County will work on compiling a report with the potentially responsive records in the possession of the County.

 

If there are records responsive to this Request, please be aware that, depending on the nature of the records and/or information sought, some or all of the records may contain information that is exempt from disclosure under one or more subdivision of Government Code section 7920.000, et al., or under Government Code section 7922.000, or pursuant to some other exemption or privilege. If only a portion of a requested record is exempt from disclosure, the record will be provided for inspection or copying with the exempt information redacted.

 

The County will inform you in the future whether there are any records responsive to your request, whether any exemptions apply, and an estimate of applicable costs. The County will contact you again on approximately December 19, 2023 and provide you with a status update.

This follows San Bernardino County’s (the “County”) response to your California Public Records Act (“Act”) request dated November 29, 2023 (the “Request”) in which you requested records pertaining to “Michelle Dawn Cain formerly Michelle Dawn Vega Requesting: schedule, salary, WPE any complaints from the start of her employment in 2008 till now.”

The County does not generally maintain a document containing the information you request, but the County does maintain such information within a database. As such, the County has uploaded a responsive document. A portion of the County records you request are exempt from disclosure as “personnel, medical, or similar files, the disclosure of which would constitute an unwarranted invasion of personal privacy” which are exempt from disclosure pursuant to California Government Code section 7927.700.
